한국경찰의 민영화 방안에 대한 연구

국문 초록

  본 연구의 목적은 경찰의 효율성 향상을 위한 방안으로서 민영화 제도를 도입하고자 한다. 경찰업무는 원래 국가의 독점적인 영역으로 국가의 영역으로만 인식되어 왔다. 그러나, 미국, 영국의 경우 경찰의 민영화는 경비, 수사, 교육훈련, 교통 등의 다양한 분야에서 민영화가 시행되고 있다. 이러한 민영화의 도입은 민영화가 경쟁원리에 따른 시장수요에 대한 대응성과 유연성을 향상시키고 능률성과 효율성을 증가시켜 국가의 비용 절감을 극대화하는 목표를 지니고 있으며 현재 증가하고 있는 치안업무를 더욱 효율적으로 처리하기위해서는 현 경찰 체제로는 인력, 시간, 예산 등의 측면에서는 한계가 있기 때문이다.
  경찰의 민영화(Privatization of Policing)제도를 도입함으로서 경찰업무의 양이 감소되고 질적으로 보다 중요한 업무에 제한된 자원을 효율적으로 배분하게 되고 절감된 예산과 인력을 질적인 향상이 요구되는 업무에 집중시킴으로서 경찰업무의 수준을 향상시킴으로서 경찰업무에 있어 효율성을 증대시켜 선택과 집중을 실현시킬 수 있도록 해야 한다.
  민영화 제도의 도입을 고려하기 위해 고찰되어야 하는 점으로 크게 3가지 측면에서 살펴보아야 한다. 첫째, 경찰의 민영화 도입에 대한 제 가치 문제는 무엇인가 ? 즉 공익성과 효율성의 가치의 고찰이다. 둘째, 경찰 민영화의 유형은 ? 다양한 민영화의 방식 중 어떤 유형이 적합할 것인가이다. 셋째, 경찰 민영화의 법적근거와 대상선정 기준은 무엇인가 ? 에 대한 접근을 통하여 경찰 민영화 도입의 고려 점을 고찰하는 것이다.

영문 초록

  An object of this study is to introduce a privatization system as a plan to improve the efficiency in the police. In the cases of America and the United Kingdom, the system is enforced in various fields like security guard, criminal investigation, training, traffic, etc. The import of the system aims for the privatization to maximize the reduction of cost by improving the countermove and flexibility against the market demands according to the theory of competition and increasing the efficiency. The reason is because there is a limit to the present police system in the aspects of manpower, time and budget, etc. to deal more efficiently with the public order, currently increasing.
  While the quantity of police work is reduced by importing the privatization system into the police administration, the limited resources can be allocated efficiently between more important work in terms of quality. Therefore, by concentrating the saved budget and manpower on the works which require qualitative improvement, the level of police work would improve and the efficiency would increase, so we could realize the choice and concentration.
  Here, we took a look at three things to consider for the introduction of the privatization system. First, what are the values? In other words, we have to inquire into the values of the public weal and the efficiency. Second, what are the types? It would be different depending on each case which type would be adequate among the various methods of privatization, however, generally the contract method is appropriate. Third, what"s the legal basis and the standard in selecting the subject for the privatization of the police force? For the legal basis, the regulations on the delegation and trust of administrative authorities must be complemented, and the standard in the selection of subjects must be determined by the following in-depth studies if necessary.
