特別司法警察의 運用실태 및 改善과제에 관한 小考

국문 초록

  특별사법경찰은 행정의 전문화에 따라 전문성과 효율성을 고려하여 특정업무를 담당하는 공무원에게 특수한 범죄에 대해 장소, 사항적 제한을 두고 사법경찰권을 부여하여 직무를 수행하도록 한 것이다. 우리나라는 1956년에 특별사법경찰제도를 도입한 이래, 2006년 현재 15개의 중앙 행정부서와 지방자치단체 등 865개의 행정기관에서 총 13,114명의 특별사법경찰이 직무를 수행하고 있으며, 그 인원은 점차 증가추세에 있다.
  그런데 특별사법경찰은 일반사법경찰에 비해 상대적으로 수사에 관한 경험이나 전문적 지식이 부족한 탓으로 수사권의 남ㆍ오용 혹은 인권침해의 우려가 있다. 또한 수사에 대한 지식과 능력의 부족으로 해당업무를 자체적으로 처리하여 검찰에 송치하지 못하고, 많은 사건들을 단순히 검찰이나 경찰에 고발하여 처리하고 있는 실정이다. 이로 인해 경찰이나 검찰의 업무에 과중한 부담을 야기 시키는 것은 물론, 수사업무에서 행정의 전문성이나 직무연관성을 살리려는 특별사법경찰제도 본래의 설립취지에도 부합하지 않는 결과를 가져오고 있다.
  이러한 현상은 첫째로 행정적 문화 환경에 따른 소극적 자세, 둘째로 수사업무에 대한 전문적 지식의 결여, 셋째로 특별사법경찰 업무의 연속성 결여, 넷째로 수사 교육의 미비 및 부실, 다섯째로 수사업무 수행을 위한 기본환경 및 부대시설 미비 때문인 것으로 나타나고 있다. 이에 대한 개선책으로 첫째 행정부서의 특별사법경찰에 대한 인식의 전환과 인사정책적 배려, 둘째로 수사교육 프로그램 강화, 셋째로 특별사법경찰에 대한 종합적인 운영, 관리 시스템이 요구된다.

영문 초록

  As administration of public bureaus is getting specialized, the Nation authorities organizes special judicial police on the consideration of its specificity and efficiency. the special judicial police is made up of the public officers who given juridical authority and performing the acting policing administration against special criminal in their field with the condition of spatial and situational limitation.
  Since introduced special judicial police system in 1956, Now in Korea, there are 13,114 special judicial police working in 865 administrative organizations including 15 central governmental administration and local autonomous entities, and the number is increasing.
  In spite of an increase in personal, there is concern about special judicial police"s committing human rights violation or abuse, misapplication that resulted from lack of experience in criminal investigation and unprofessional knowledge compare to the general police.
  At present, what special judicial police do is just to denunciation many incidents or accidents to the police or the prosecutor and let them deal with the cases instead of carrying out their duties by themselves and sending the criminals to the prosecution because they have shortly experienced in criminal investigation and do not fully understand policing skills. Special judicial police"s shortage of quality such as incapability, unprofessional ways and inexperience cause not only imposing a heavy burden on police duty but also not corresponding to the original purpose of their establishment which is for specialization of criminal investigation and official interconnection.
  We can notice several reasons that make these negative outcomes, first, passive attitude following bureaucratic conservative atmosphere, second the shortage of professional knowledge in criminal investigation, third, inefficient discontinuance as special judicial police, forth, insufficiency of institutional education on how to investigation, and last, poor environment for investigation and the lack of subsidiary facilities.
  In order to improve these situation, there are several requirements, first, to change the recognition toward the special judicial police, consideration of fair personnel policies, second to enhance constructive educational program on investigation learning and the last, integrating system of management and operation for special judicial police.
