국문 초록

  사회가 개방되고, 인터넷 등 정보의 홍수 속에 살면 살수록 아이들의 자유와 재랑도 정점 커질 수박에 없다. 그러므로 다른 어떤 분야보다 학교현장에 우선적으로 재원이 분배되어야 하고, 보다 우수한 교사들이 책임감 있게 지도하는 것이 중요하다.
  ‘학교폭력예방 및 대책에 관한 법률’은 “학교폭력의 예방과 대책에 관하여 필요한 사항을 규정함으로써 피해학생의 보호, 가해학생의 선도ㆍ교육 및 피해학생과 가해학생간의 분쟁조정을 통하여 학생의 인권을 보호하고 학생을 건전한 사회구성원으로 육성”할 것을 목적으로 제정되었다. 하지만 엄밀하게 표현하면 현행법은 결코 학교폭력의 예방과 대책에 관한 완전한 해결책이라고는 결국 할 수 없는 것이다. 더욱이 법률이 규정한 예방책이나 대책은 시행령 단계에서 유명무실한 것으로 전락되기도 하였다.
  미국, 캐나다를 비롯한 선진 각국 등은 끊임없는 프로그램의 재발과 범정부차원의 지원을 통해 학교폭력의 예방과 선도보호에 만전을 기하고 있고 여기에 경찰력의 활용은 매우 효과적인 역할을 하고 있음이 여러 연구에서 증명되고 있는 실정이다.
  이제 한국에 있어서도 경찰의 대외적인 위상과 이미지는 과거와 많이 다르게 변하였다. 또한 성공적인 학교경찰의 정착은 그러한 경찰의 신뢰감의 형성을 더욱 가속화 하게 될 것이라 확신한다. 좀더 진지하고 신중한 검토를 바탕으로 한국적 학교경찰제도의 도입을 위해 정부와 사회 모두가 머리를 맞대야 할 것이다.

영문 초록

  Recently, one of the most serious troubles of our society is that the ages of wrongdoers involved in all kinds of misdemeanors and crimes have decreased gradually, i.e. juvenile delinquency has upsurged, and to make a bad situation worse, a majority of the involved juveniles including middle-school students and even elementary-school students have perceived neither the sense of guilt nor the seriousness of their wrong behaviors, in spite of generating many social problems.
  For school violence such as sexual abuse, it is desirable to approach the solution with school education enabling students to protect and develop positively their own mental health and correct personality, rather than with heavy punishment or oppressive control and supervision. To do so, schools should invite the professional teachers with a strong sense of responsibility, furthermore, reinforce training for their teachers so that all teachers take actively appropriate actions against such problems, and operate the relevant substantial educational programs.
  "The Law on Preventive Measures Against School Violence" is intended to "protect the human rights of all the relevant students and guide the students into sound social members through protection of victims, proper guidance of wrongdoers and conflict mediation between both the parties, by defining the requirements for preventive measures against school violence. Strictly speaking. however, the current law cannot be evaluated as a perfect solution for prevention of and preventive measures against school violence at all. Especially, the preventive measures defined by the law revealed ineffectiveness at the phase of enforcement ordinance.
  Now, the external position and image of Korean police are very different from that in the past. In addition, obviously, successful establishment of school police will speed up formation of firm reliance on the police among the people. Based on more careful and close examinations, both the Government and the society should try to find the best approach to introduction of school police into Korea.
