마약류 중독에 의한 정신범죄 분석

국문 초록

  본 연구는 마약류 중독에 의한 정신범죄 예방을 위한 연구로서, 이론과 실태를 중심으로 조사 분석한 연구이다. 마약류 중독의 일반적 특성과 중독으로 인한 정신범죄를 논의함과 아울러 마약류 중독에 의한 정신범죄적 특성을 분석하였다. 본 연구의 중심 내용인 마약 중독에 의해 어떠한 정신범죄가 발생되었는지에 대해 자료 수집 등으로 분석한 바 살인·강도·방화·자살 등 우리가 상상하지 못한 범죄가 발생되었다는 것이 입증되었으며, 메스암페타민이라는 필로폰은 불안, 초조, 금단 증상에 의해 환각 등 제2의 정신범죄가 발생된다는 것은 당연한 것으로 입증되었다. 따라서 이와 같은 특성과 사례들을 통해 마약류중독에 의해 정신범죄예방과 문제해결을 위해서는 마약류 중독의 치유를 위해서 크게 마약류 중독예방과 중독치유의 2가지 방안을 제시하였다.
  첫째, 마약류 중독예방으로는, 일반적인 마약류 중독화 과정차단, 모델링과 현실에 대한 도피성 차단으로 모델링, 현실도피, 생물학적 원인의 제거, 유전적 원인을 제거하는데 민간단체 또는 정부기관의 지속적인 노력이 필요하다.
  둘째, 마약류 중독자 치유 방안으로 우선적인 목표가 마약류 사용 중단이다. 이러한 목표달성을 위하여 혐오요법, 자극대체기법, 보상효과를 차단하는 방법, 마약류 투약자에 대한 대체의료교정 방안 등을 제시했다. 특히 마약류 중독에 의한 정신범죄는 중독자 자신은 물론 가족 시민 등 주변인들이 이유 없이 피해를 입는다는 점에서 홍보와 계몽으로 마약의 위험성이나 폐해에 대해 정신의학적 근거에 의한 사전 예방이 절대적이다. 따라서 이미 중독 된 자를 격리시켜 치유시킬 수 있는 의료용 모델로 전환시키고 현재의 마약류 투약 범죄자 교정정책을 대체의료교정으로 전환시켜야 한다.

영문 초록

  A thesis is surveyed and analyzed based on the theory and reality condition as the mental criminal prevention. This study attempted to investigate what mental crimes were caused by drug addition or narcotism, its central content. As a result, it was proved that drug addition occasioned such unimaginable crimes as murder, burglary, arson, suicide and the like. It was proved that it was taken for granted that philopon named Mesamphetamine caused a second mental crime such as anxiety, impatience, symptoms induced by withdrawal symptoms.
  To prevent the mental crime induced by drug addition and resolve its related problem through those characteristics and cases, this study attempted to present the remedy for drug addiction by dividing it into the following two:
  First, non-governmental organizations or government agencies need to make efforts to eliminate escape from the reality, biological causes and heritary cause as the measure to disconnect as well as modelling for disconnecting the process of drug addiction and for disconnecting an escape from the reality as the measure to prevent drug addiction.
  Second, the primary objective of the plan to cure drug addicts is to stop them from using drugs. To attain this goal, this study attempted to present the hate therapy, the stimulus replacement therapy, the method of disconnecting the reward effect, the alternative medical correction method to drug addicts and the like. Especially, it is absolutely necessary to prevent drug addiction in advance based on mental medicine on the riskiness or adverse effects of drugs through publicity and enlightenment in that the mental crimes induced by drug addiction have an adverse effect on both drug addicts and people around them without any cause. Accordingly, this study argued that it be necessary to switch to the medical model able to isolate and cure drug addicts and change the current correctional policy for drug addicts into the alternative medical correctional policy.
