국문 초록

  재판심리란 일반적으로 법에 심리학을 응용한 것이라 할 수 있다. 범죄자에 대한 재판과정에서는 법관의 다양한 기술들이 요구되며, 이런 관점에서 이 연구에서는 피의자의 진술·증언과 재판심리, 진술·증언과 신뢰성, 사법적 판단과 법관의 인격, 재판진행과정과 판단에 대하여 살펴본다.
  증언의 심리학이란 목격자의 증언의 정확성과 완전성에 어떠한 요인이 영향을 주고 있는지를 연구하는 것이다. 재판에 있어서 정보는 매우 중요한데, 재판이 진행하는 동안에 많은 정보와 유리한 증거를 확보하는 것에 따라 판결이 달라진다는 것을 생각할 수 있다. 이 연구에서는 법관의 사법적 판단과 인격과 관련하여 법적 해석문제에 있어서 법관의 인격이 반영된 사례라고 보여 지는 뉴저지 주의 6인 판사의 10년 간 판결문 기록을 조사한 내용을 분석하였으며, 동일한 사건에 대해서 양형(量刑)을 조사하기 위하여 법관 16명과 대학원생 23명에게 “몇 년형인가”를 조사하였다.
  재판이란 일반적으로 법관이 구체적 사실에 법규를 적용하고, 필연적으로 일정한 결론을 이끌어내는 것이다. 이 연구에서는 안더손이 중혼(重婚)이라는 것으로 기소된 소송사건의 자료를 분석한 것을 살펴보았다. 법관의 사실인정을 올바르게하고 그 심증형성을 과학적으로 통제하기 위해서는, 최근에 발달된 과학적 심리학의 성과를 도입하는 것이 필요하다.

영문 초록

  Trial psychology is the application of the psychology to the law. Various judiciary techniques are required in the process of criminal prosecution. Among these various techniques, this study will emphasize on a few of them, particularly on the victim’s verbal testimony and trial psychology, verbal testimony and credibility, and judicature judgment and the personality of the judiciary.
  The psychology of verbal testimony is a study that involves establishing what elements are influencing the accuracy and completeness of the witness" testimony. Because the facts are critical to a trial, the outcome of a trial can change as more information and accurate evidence are acquired during the trial. This study establishes that there is a problem with judicature judgment and the interpretation of the law according to the personality of the judiciary. The records of the 10 year decision by six New Jersey judges that exemplifies the previously mentioned personality of the judiciary, was analyzed. In addition, the variability in case assessment of identical incidents was examined by studying 16 judiciaries and 23 graduate students by obtaining their determination of sentence duration for those identical incidents.
  A trial is primarily the application of laws and regulations to an accurate truth and then extrapolating a conclusion. The case studied was that of Anderson"s bigamy indictment. In order to correct the acceptance of the truth and to scientifically control the establishment of a belief in a verdict, the introduction of recent scientific advances in psychology is necessary.
