국문 초록

  반다수결주의에 입각한 법조통치와 과도한 헌법재판에 대한 민주적 통제에 직면하여 헌법재판의 기능에 대해 일반적인 설명을 하고, 한국헌법재판소의 관할에 대해 위헌법률심판과 헌법소원심판을 중심으로 소개하였으며, 나아가 재판소원배제에 대한 한국헌법재판소의 결정을 소개하고 있다. 한국헌법재판소의 위 재판소원배제에 관한 한정위헌결정에 대해 비례의 원칙(과잉금지원칙)의 내용을 분석하여 그 원칙의 적용상의 문제점을 밝혀 비판하였다.
