줄기세포 연구에 대한 헌법학적 논의의 문제점

영문 초록

  This paper aims to evaluate current constitutional approaches to the stem cell research. In this paper, four types of mistake involved with those approaches are examined in each part of it.
  First, mistakes concerning a proper use of the fundamental concepts such as human embryo, human embryonic stem cell, totipotency, pluripotency and multipotency (chapter Ⅱ).
  Second, mistakes concerning the validity of argument using the concepts of human dignity and right to life, respectively (chapter Ⅲ).
  Third, a lapse of concentration on the latest trend towards stem cell research guide due to negligence, and several mistakes it causes scholars to make (chapter Ⅳ).
  Fourth, failure to pay attention to the uniqueness of problems newly encountered in this biotechnical era (chapter Ⅴ).
  In addition, the comparison among contents of the new bill of the Bioethics and Biosafety Act (2007), NRC Guidelines for Human Embryonic Stem Cell Research (2005) and ISSCR Guidelines for the Conduct of Human Embryonic Stem Cell Research (2006) is provided in this paper (especially chapter Ⅳ).
