국문 초록

  국제무역에서 중소수출입업체에 대하여 보험계약자등의 불이익변경금지 원칙 단서조항의 획일적인 적용은 본 조항의 입법취지에도 불구하고 영세한 중소수출입업체에 대하여 보험보상처리에서 가혹한 결과를 초래하는 불합리한 점이 발생하고 있다.
  따라서 본 연구는 중소수출입업체들이 형평성에 어긋남이 없이 공정하게 보험보상이 될 수 있도록 하기 위하여 상기 동조항 단서의 탄력적인 적용을 위한 개선방안을 연구하였다.

영문 초록

  Entirely adopting exemption of the principle(the Article 663 of Commercial Act) of Prohibition of Entering Special Agreement which is Disadvantageous to Policyholder, etc. in Internet Cargo Insurance for mid-small company has incurred results unexpected that gave disadvantage for giving money claimed to mid-small company who has not have a well organization concerning insurance and/or legal department, in spite of a good legislating intention that want to protect the interest of private policyholder on non-commercial line insurance of non-life insurance.
  Under abovementioned circumstances, this study propose ideas of protecting interest of mid-small company in cargo insurance as follows : - firstly on focus of making legislation of Commercial Act, the principle(the Article 663 of Commercial Act) may be revised, ie this principle should adopt to two direction divided big company and mid-small company by case by case. This means that the said principle can be adopted on the basis of actual size of company and claim amount raised by cargo owner(policyholder).
  lastly a right/correct guide to cargo insurance should be forwarded to cargo owner(policyholder) of mid-small company in order not to be excluded the interest of cargo insurance as this is a duty of cargo underwriter as seller of insurance.
