헌법개정의 과제와 전망

국문 초록

  1948년 헌법을 제정한 직후부터 끊임없이 제기된 개헌논의는 평균 4년 4개월마다 한번 씩 정치적 계기에 의해 어설픈 매듭을 지어 왔다. 그러나 대부분의 개헌이 정치적 야욕으로 얼룩져왔다.   현행헌법으로의 개정이후에 전개되고 있는 개헌논의도 정치적인 입장에서부터 순수하게 학구적인 입장에 이르기까지 다양한 개헌론이 전개되어 왔다. 과거를 기억하고 있는 국민들의 의혹에 찬 시선도 없지 않다. 그러나 개헌에 대한 부정적 이미지나 개정이라는 좁은 의미를 넘어 대한민국을 한 단계 더 상승시킬 수 있는 제대로 된 헌법을 한번 만들어 보자는 각계의 다양한 움직임도 진행되고 있다.   개헌의 과제로는 현실과 규범의 조화, 21세기 선진입국, 통일국가의 지향, 사회적·정치적 통합, 생태적·민주적 법치국가의 달성 등이 우선적으로 고려되어야 한다. 무엇이 개헌의 구체적 내용으로 거론되어야 할 것인지에 대한 시각은 헌법과 개헌에 대한 입장에 따라 편차가 매우 클 수밖에 없다. 대체로 헌법전체의 체계개편에서부터 총론분야의 영토조항과 경제질서에 관한 규정, 기본권의 체계와 개별 기본권 그리고 권력구조 등이 많이 거론되고 있다.   개헌의 전망에 있어서 무엇보다 중요한 것은 역시 정치권의 입장이다. 각각의 정파가 가지는 이해관계나 국민들의 따가운 시선에도 불구하고 대승적 차원에서 적극적인 동참을 할 수 있는가 하는 점이다. 그렇지 않아도 개헌에 있어 논란이 예상되는 몇몇 분야는 국민들 사이에서도 첨예한 의견의 대립이 예견되고 있으므로 이런 어려움을 무릅쓰고 과연 보신적 이해관계에 밝은 정치권이 얼마나 추진력을 발휘할 수 있을 것인지 미지수다. 경우에 따라서는 조기에 개헌논의가 좌초할 수도 있다.

영문 초록

  Since 1948 when the Constitution was first established, there have been endless discussions over revising the Constitution every four years and four months on the average, which were always concluded incompletely. Most of the Constitutional amendments were overshadowed by political plots.   After the last amendment to the exist Constitution, there have also been a wide range of discussions from the political view to the scientific view without alloy on the new revising of Constitution. It is true that some people who remember the negative past are looking them with doubtful eyes. Nevertheless, the active movements of various circles are going on, and they advocate making the truly creditable Constitution which could make a great contribution to the rising of Korea to the advanced step, except for the negative images of amendment and over the only narrow meaning of the Constitutional amendment.   There are some important tasks to be primarily concerned for the Constitutional amendment study: harmonizing of norm with reality, entering the advanced country of 21century, aiming for unified country, internal unification of society and political parties, and the achievement of being a law governed country both in ecological and democratic ways. Not surprisingly, the gap is remarkably wide, about the concrete contents of the future Constitution revised, between people who have different views on the Constitution itself and the Constitutional amendment. Several subjects are mainly discussed from the complete reform of the Constitutional system to detail amendment, such as the regulation of a territory clause and the economic order. They also raised the amendment of the system of Human Rights, the individual Human Rights, power structure, and so on.   As might be expected, it is the view of politicians that the prospect of the Constitutional amendment depends on after all. It is a matter of whether they can join the procedure actively from a broad point of view, not regarding any interests of individual political parties and beady-eyed people. Indeed, there will be sharp conflicts between people over several controversial fields of the Constitutional amendment. In this situation, it is unclear whether politicians who are skilled to calculate loss and gain can show their impellent power running risks like this. The debates on Constitutional amendment may be over early by some possibility.
