영문 초록

The International Chamber of Commerce(ICC) provides expert documentary instruments dispute resolution system in accordance with its Rules for Documentary Instruments Dispute Resolution Expertise(DOCDEX). This is a rapid, cost-effective dispute resolution system intended to resolve disputes involving ICC rules on documentary credits. Expanded in March 2002, to cover the ICC Uniform Rules for Collections and the Uniform Rules for Demand Guarantees, DOCDEX has been used by traders and bankers. The purpose of this study is to analyze two different dispute resolution system for letters of credit. First, DOCDEX system is a form of alternative dispute resolution made by International Chamber of Commerce. DOCDEX is inexpensive, expeditious and non-binding dispute resolution system through the decision of expert appointed by the International Center for Expertise. Second, International Center for Letter of Credit Arbitration (ICLOCA) system is expert-based arbitration administered by the Rules of Arbitration for Letter of Credit Disputes. DOCDEX and ICLOCA have their own merits and demerits and different characteristics. So the parties to letter of credit disputes should choose a proper dispute resolution system with prudence for a satisfactory settlement.
