영문 초록

The establishment of multimodal transport operator's single liability is the most important in the multimodal transport which was introduced with the advent of container in 1960s. International regulation on the multimodal transport operator's single liability was adopted UN Convention on International Multimodal Transport of Goods in 1980, but is ineffective. UNCTAD/ICC Rules for Multimodal Transport Documents(UNCTAD/ ICC Rules) prepared in 1992 performs alternative roles. Based on this rule, Standard Conditions governing the FIATA Multimodal Transport Bill of Lading(FBL) in 1992 which was issued by FIATA is now available around the freight forwarders' world. And Standard Conditions governing KIFFA Multimodal Transport Bill of Lading(K B/L) was issued in 1997 by KIFFA is now used in KIFFA members. This paper aims to study on the freight forwarder's carriage liability against merchant in K B/L This paper aims to study on the freight forwarder's carriage liability against merchant in K B/L conditions compared with UNCTAD/ICC Rules and FBL standard conditions. As a result, K B/L conditions have problems in liability principle and limitations of liability. As for liability principle, freight forwarder's arbitrary interpretation is possible. Concerning the problem of limitations of liability, assessment of standard of limitation of liability, scope of independent contractor in liability of servants and other persons of carrier, liability applicable to losses occurring within a port during movement of cargo to transshipment terminal, ommission of loss of right to limit liability are involved.
