교원노조의 노동기본권과 타 교육관련 주체의 권리 및 권한관계

국문 초록

본 연구에서는 교원의 지위의 이중성(교원의 교육자성, 근로자성)에 따른 교원노조의 노동기본권의 특성을 밝히고, 그 범위를 어느 정도로 인정할 것인가에 관하여 고찰하였다. 특히 교원노조의 구성원인 교원은 현대공교육제도에서 학생교육을 위하여 학부모, 국가 등 여러 교육관련주체와 협력관계에 있기 때문에, 교원노조의 노동기본권의 범위를 정하는 데 있어서 이들의 교육권과의 관계를 고려하였다. 먼저 교원노조의 단체교섭권의 대상범위와 관련하여, 교육내용, 교육방법 또는 교육정책에 관한 사항이 교섭범위에 포함되는지 여부에 관하여 국가의 교육권한과의 관계에서 고찰하였고, 이어서 교원노조법이 규정하고 있는 단체교섭신중의무와 관련해서는 국가에 대한 교육조건정비요구권을 중심으로 교원과 학부모의 협력관계를 살펴보았다. 그리고 마지막으로 교원노조에게 단체행동권을 인정할 것인지에 관해서는 교원의 단체행동으로 인하여 가장 피해가 클 것으로 예상되는 학생의 학습권을 비롯한 제반 권익과의 관계를 다루었다.

영문 초록

This study aims to examine acceptable and acknowledged scope of 'Labor Rights' of Teachers Union, through illuminating main characteristics of the Union's labor rights according to dualism of teachers' legal and social status(including their status as both teachers and workers). For this purpose, especially, it is significantly considered that teachers' educational rights are closely related to prescribing the scope of labor rights of Teachers Union, because teachers, as legal members of Teachers Union, have cooperative relationship with diverse education-related agents(including parents, state and government-run institutions, etc.) for students under the present public educational system. First of all, as for targeting scope of the 'Rights of Collective Bargaining', the study analyzes whether comprehensive matters in educational substances, methods and policies are included in its bargaining procedure and limits in terms of state's or government's authorized competence in education. Second, in regard to 'sincerity obligations' of collective bargaining in Teachers Union regulations cooperative relationship between teachers and parents is examined with laying stress on their demanding rights of educational conditions readjustment to national government. And finally, concerning legal acknowledgement of Teachers Union's 'Rights of Collective Action', the study investigates students' Right to Learn and other overall rights and interests which are expected to be most damaged by teachers' collective actions. In conclusion, this analysis can contribute to our advanced legal understanding and perception of teachers' labor rights more broadly and precisely. And it can also provide education-related agents with significant opportunities with more legal-oriented mutual communication for their shared value in both their legal and pedagogical aspects.
