영문 초록

The aim of this article is to gather from the foreign laws, old and modern, and analyse the materials on the problem, whether and in what scale the Regulation of mortgage and utilitation is to be recognized, and to provide some background knowledge which might be useful when an opportunity to think about the possibility of the legislation about this delicate problem is given. The range of the materials gathered here reaches from the foundation of japan civil law to the recently enacted a judicial precedent on the legal superficies and bundle auction.
