영문 초록

This paper is a study on the Decision of Korean Supreme Court dated September 4.2001 (2001da13976). The Korean Supreme Court and many korean scholars are of opinion that Guarantee Insurance is a property insurance in the nature of guarantee. But the relation between the character of insurance and that of guarantee is not clear and accurate. This paper makes a particular effort to set up a clear legal nature of guarantee insurance. On the other hand Advance Payment is usual in construction contract. But the legal nature of advance payment is not unanimous. Therefore this paper pays a special atten tion to the legal nature and the consequence of advance payment.
