팬데믹, 생명의료윤리, 사회정의- N. 대니엘스의 ‘정의로운 건강’이론 -

국문 초록

자유민주주의 국가는 (1) 국민들이 적절한 삶을 살 수 있도록 분배정의를 실현해야 하는 의무와 (2) 국민들의 건강을 공정하게 보호해야 할 의무를 갖는다. 그런데 평시에도 여러 국가들이 이런 의무들을 다하지 못해서 부정의들이 발생해서 온존해 오다가, 코로나19 팬데믹으로 인해 이런 부정의들이 악화되면서 극적으로 노정되었다. 이런 부정의들을 시정하고 보다 공정한 사회를 재건하기 위해서 여러 학자들은 ‘사회정의론’과 ‘국민건강 정의론’을 제시했는데, 사회정의론에는 (i) 다학제적 사회정의론과 (ii) 전통적 사회정의론이 있고, 국민건강 정의론에는 (i′) 보건의료 중심적 정의론, (ii′) 사회적 결정요인 중심적 정의론, (iii′) 보건의료와 사회적 결정요인 통합적 정의론이 있다. 그런데 사회정의론과 국민건강 정의론은 밀접한 관련을 갖는데, 국민건강 정의론 (ii′)와 (iii′)은 건강의 사회적 결정요인들을 통제하기 위해서 사회정의론 (i)이나 (ii)를 원용하기 때문이다. 이런 정의론의 맥락을 배경으로, 필자는 우선 사회정의론의 한 예인 롤즈의 공정으로서 정의론이 적절한 사회정의론이 될 수 있다고 논증했다. 그 후에 필자는 국민건강 정의론을 논하는데, (i′)에 속하는 이론들은 부적절하고 (ii′)에 속하는 이론들은 부적절하거나 보완될 필요가 있기에 (iii′)에 속하는 이론들이 적절하고, 이런 이론의 한 예로 N. 대니엘스의 정의로운 건강 이론이 적절한 국민건강 정의론이 될 수 있다고 논증했다.

영문 초록

A liberal democratic country has (1) the duty to realize a proper distributive justice in order for people to live adequate lives and (2) the duty to protect its people’s heath (or population health) fairly. But many countries failed to fulfill these duties so that injustices were generated and retained in the societies. When Covid-19 pandemic hit those countries, those injustices were dramatically exposed. In order to correct those injustices and build a fairer society back, scholars have proposed theories of social justice and theories for population health. Theories of social justices could be divided into (i) multi-disciplinary theories and (ii) traditional theories of social justice. Theories of justice for population health could be divided into (i′) health care-centered theories, (ii′) social determinants-centered theories, (iii′) health care-social determinants integrated theories. But theories of social justice and theories of justice for population health are closely related because (ii′) and (iii′) utilize either (i) or (ii) to control social determinants. In this contexts of theories of justice. I first argue that, as an example of theories of social justice, Rawls’ theory of justice is an appropriate theory of social justice. And then I argue that theories which belong to (i′) are inappropriate, theories which belong to (ii′) are either inappropriate or need to be supplemented, and theories which belong to (iii′) are appropriate. I further argue that N. Daniels’ theory of ‘just health’ is an appropriate theory of justice for population health.
