전국 특수학급 과밀 배치 현황 분석을 통한 한국 통합교육 정책과 특수교육법 개정 방안

국문 초록

이 연구는 전국 17개 시도 유․초․중․고등학교 특수학급 과밀 배치 현황 분석을 통해 통합교육 지원을 위한 정책과 법률적 대안을 찾는 데 목적이 있다. 연구방법은 전국 17개 시‧도를 대상으로 수집한 2020년-2022년까지 특수학급 현황 자료의 특수학급 증감수 비교와 각급학교 특수학급당 학생수가 법적 배치기준 인원을 초과하는 학급수 비교를 통해 과밀학급 비율을 산출하여 분석하였다. 연구 결과 첫째, 최근 3년간 특수학급 증가율은 향상되었고, 학교급별로는 유치원 특수학급이 가장 높았다. 둘째, 2022년 기준 과밀학급 비율은 제주가 가장 높았으며, 학교급별로는 유치원이 가장 높았다. 또한 꾸준한 특수학급 설치 증가율에도 오랜 기간 누적된 특수학급 신증설의 기피로 여전히 유․초․중등학교 특수학급 과밀 비율이 높은 것으로 나타났다. 결론적으로 「장애인 등에 대한 특수교육법」에 근거한 특수학급 설치는 통합교육을 실현하기 위한 가장 기본적인 전제조건임에도 최근 3년간 특수학급 신증설을 위한 국가의 노력은 여전히 미흡한 것으로 나타났다. 따라서 실질적으로 특수교육대상학생을 위한 의무교육권 보장을 위해서는 현행 특수교육법상의 유‧초‧중‧고등학교의 특수학급을 신증설의 실질적 권한을 학교장에서 교육감으로 변경하고, 특수교육대상학생이 거주지에서 가까운 일반학교 내에서 필요한 통합교육을 받을 수 있는 기본적인 권리를 보장하는 조항을 강제조항으로 개정할 것을 제안하였다.

영문 초록

The purpose of this study is to find policies and legal alternatives to support inclusive education by analyzing the current status of overcrowding of special classes in kindergarten, elementary, middle, and high schools 17 cities and provinces nationwide. The research method is to compare the increase or decrease in the number of special classes in special class status data from 2020 to 2022 collected from 17 cities and provinces across the country and to compare the number of classes in which the number of students per special class in each school exceeds the legal placement standard to determine overcrowding. The class ratio was calculated and analyzed. The results of this study are as follows: first, the growth rate of special classes has improved in the past three years, and the kindergarten special class has the highest rate by school level. Second, the overcrowded class ratio in 2022 was the highest in Jeju, and the kindergarten was the highest by school level. In addition, despite the steady increase in the number of special classes, the overcrowding rate of special classes in kindergarten, elementary, middle and high schools was still high due to the avoidance of accumulated special class expansion. In conclusion, the establishment of special classes based on Special Education Act is the most basic precondition for realizing inclusive education, but the efforts of the nation for the expansion of special classes for the past three years are still insufficient. In order to guarantee compulsory education rights for students with special needs, it is suggested to change the actual authority to expand and expand special classes in kindergartens, elementary schools, middle schools, and high schools under the current special education Act from the principal to the superintendent of education, and to amend the provision to guarantee basic rights for students subject to special education to receive necessary inclusive education in general schools close to their residence.
