국문 초록

유럽평의회(Council of Europe: CoE)는 스포츠 경기조작을 방지하고 이를 적발하고 처벌하는데 있어서의 국제협력을 강화하기 위하여 2014년 「스포츠 경기조작에 관한 유럽평의회 협약(마콜린 협약)」을 채택하였고, 2019년 발효하였다. 동 협약은 스포츠 경기조작에 대응하기 위한 유일한 국제법 규칙으로서, 스포츠 경기조작 및 불법 스포츠도박에 관하여 국내 및 국제 스포츠 대회의 국가적 또는 초국가적 조작을 방지, 감지 및 제재하고, 공공기관 및 조직 간의 승부조작에 대한 국내 및 국제협력을 촉진하는 것을 목적으로 한다. 협약은 그 목적을 달성하기 위하여 협약에서 요구하고 있는 내용의 이행 의무자에 체약국 외에도 모든 이해관계자, 즉 스포츠 단체, 대회 주최자, 스포츠도박 사업자, 도박 규제기관을 포함시키고 있으며, 국내외 모든 이해관계자 간의 협력체계를 구축하기 위하여 각 체약국에 대해 ‘내셔널 플랫폼(national platform)’이라는 혁신적 체계의 구축을 요구하고 있으며, 협약의 이행상황을 모니터링 하기 위한 후속 위원회(Convention Follow-up Committee)의 설치를 규정하고 있다. 마콜린 협약은 전문을 포함한 총 9장 41개의 조문으로 구성된 법적 구속력이 있는 국제법 문서로서, 그 내용은 크게 ① 방지(prevention), ② 법의 집행(law enforcement), ③ 국제협력 조치(international co-operation measures), ④ 정보 교환(exchange of information) 및 ⑤ 후속 조치(follow-up to the convention)로 나누어져 있다. 또한 스포츠 경기조작과 불법 스포츠도박의 문제가 범 세계적인 맥락에서 해결되도록 하기 위해 유럽평의회 회원국이 아닌 국가도 대하여도 협약의 가입을 허용하고 있다. 따라서 우리로서도 동 협약에의 가입 여부에 관심을 가질 필요가 있으며, 그러한 점에서 협약의 내용을 검토하는 데에 의의를 찾을 수 있다. 그러므로 본고는 마콜린 협약의 주요 내용을 소개하고, 그 시사점을 제시하는 것을 목적으로 한다.

영문 초록

An effective fight against the Manipulation of Sports Competitions requires increased, rapid, sustainable and properly functioning national and international co-operation. To this end, 「the Council of Europe Convention on the Manipulation of Sports Competitions」(“Macolin Convention”) was concluded in Macolin, Switzerland on 18 September 2014 and entered into force on 1 September 2019. The convention is open to member States as well as non-member States of the Council of Europe. The Macolin Convention is a legal instrument and the only rule of international law on the manipulation of sports competitions. The main objectives of the convention are to prevent, detect and sanction national or transnational manipulation of national and international sports competitions, and to promote national and international co-operation against match-fixing between the public authorities as well as with organisations involved in sports and in sports betting. It requests public authorities to co-operate with sports organisations, betting operators and competition organisers to prevent, detect and sanction the manipulation of sports competitions. It proposes a common legal framework for an efficient international cooperation to respond to this global threat. The convention also provides for the introduction of a mechanism to exchange information between the various national systems, the national platform. The convention is structured by way of a Preamble with 9 Chapters made up of 41 Articles that cover in total: prevention, law enforcement, international co-operation measures, the exchange of information and follow-up to the convention. The purpose of this article is to review the main contents of the convention and to present the implications.
