교통유도경비제도 도입에 따른 법체계 논의

국문 초록

매스로우(Maslow)의 욕구 5단계 중 기본적인 욕구인 안전욕구가 충족되지 않았던지난 10･29 참사를 겪으면서 우리 사회에서는 인파관리의 중요성이 대두되었다. 이는 민간경비 분야에 있어서는 교통유도경비업무의 도입과 관련된다. 그러나 교통유도경비제도의 필요성에 대하여는 충분한 선행연구가 있으나, 실제로 교통유도경비제도가 도입될 경우 ｢경비업법｣상 경비업무 체계, 경비원 체계, 신임교육 체계, 배치신고 체계 등에 대한 구체적인 연구는 미비하므로 본 연구에서는 이채익의원 등이제안한 ｢경비업법 일부개정법률안｣을 중심으로 체계적이고 합리적인 입법 대안을다음과 같이 제시하였다. 첫째, 교통유도경비업무는 시설경비･호송경비･신변보호･기계경비･특수경비업무와 별도의 경비업무로 구분하여 규정하여야 할 것이다. 둘째, 교통유도경비원은 일반경비원에 포함되도록 규정하여야 할 것이다. 셋째, 일반경비원 신임교육과목에 교통유도경비실무 과목을 추가하여야 할 것이다. 넷째, 집단민원현장이 아닌 곳에 교통유도경비원을 배치할 경우에는 배치 전에 신고하고, 집단민원현장에 교통유도경비원을배치할 경우에는 배치 48시간 전까지 배치허가를 신청하도록 규정하여야 할 것이다. 교통유도경비제도가 도입될 경우, 교통사고 예방, 원활한 교통소통 등으로 인한 사회적비용이 절감될 것이며, 혼잡 상황에서의 인파관리에 따른 사고방지 등으로 인한 시민안전이 확보될 것이다. 나아가 민간경비산업 발전에도 기여할 수 있으므로 이제는 ｢경비업법｣ 에 변화하는 사회현실을 반영한 교통유도경비제도를 도입하여야 할 것이다.

영문 초록

Korea has not introduced a traffic inducement security system. However, as the importance of crowd management has recently emerged, discussions on the introduction of traffic inducement security services are active. Therefore, when the traffic inducement security system is introduced, a reasonable legislative alternative to the security service system, the security guard system, the new education system, and the placement report system under the ｢SECURITY SERVICES INDUSTRY ACT｣ is proposed. First, traffic inducement security should be classified into facility security, escort security, personal protection, mechanical equipment, and special security services, and separate security services. Second, traffic inducement guards should be stipulated to be included in general security guards. Third, it is necessary to add a practical course for traffic inducement security to the new training course for general security guards. Fourth, if a traffic inducement security guard is deployed in a place other than a collective petition site, it should be stipulated that a report is made before the placement. If the traffic inducement security system is introduced, social costs due to traffic accident prevention and smooth traffic communication will be reduced, and civil safety will be secured due to the prevention of accidents due to crowd management in crowded situations. Furthermore, since it can contribute to the development of the private security industry, it is now necessary to introduce a traffic inducement security system that reflects the changing social reality in the ｢SECURITY SERVICES INDUSTRY ACT｣.
