국문 초록

우리나라는 기술 유출 발생 시 국가의 안전보장 및 국민경제의 발전에 중대한 악영향을줄 우려가 있는 기술을 국가핵심기술로 지정하고 보호하고 있다. 이에 산업기술보호법은기술이전이라는 합법적인 형태로 해외 유출되는 것을 방지하기 위하여 국가핵심기술 수출시 승인신청·신고 제도를 두고 있다. 그러나 현행 국가핵심기술 수출통제제도는 현장을반영하지 못하여 기업 활동에 걸림돌이 되는 것으로 개선이 필요하다는 의견이 존재한다. 특히, 특허와 관련된 국가핵심기술의 경우 특허법과의 관계 또한 고려해야한다. 따라서 본연구에서는 국가핵심기술에 해당하는 특허권의 해외이전 시 적용되는 규제의 문제점을 산업기술보호법과 특허법을 중심으로 논의한다. 연구결과 해당 규제는 균형성, 실효성, 일관성의 차원에서 문제점이 발견되었다. 규제에 따른 정당한 보상이 없으며, 규제의 실효성과일관성이 부족하였다. 본 연구에서는 해결방안으로 정당한 보상과 인센티브 제공 확대를제안한다. 그리고 국방관련 특허 출원 시의 취급절차를 차용하여 국가핵심기술 관련 특허를 출원 단계에서부터 보호하는 방안을 제시한다. 본 연구는 국가핵심기술 특허권의 특허로서의 성질과 국가핵심기술로서의 성질을 절충함으로써, 보다 실효성 있는 규제로 나아가는 데 기여할 것으로 생각된다.

영문 초록

Korea designates and protects technologies that are likely to have a serious adverse effect on national security and national economic development in the event of a technology leak as national core technologies. The Industrial Technology Protection Act has a system to apply for and report approval when exporting national core technologies to prevent them from being leaked abroad in a legal form of technology transfer. However, the current national core technology export control system did not reflect the field, and it was found to be an obstacle to business activities. In particular, in the case of national core technologies related to patents, the relationship with patent law should also be considered. Therefore, this study discusses the problems of regulations applied to the overseas transfer of patent rights, which are national core technologies, focusing on the Industrial Technology Protection Act and the Patent Act. As a result of the study, problems were found in the regulation in terms of balance, effectiveness, and consistency. There was no fair compensation according to the regulations, and the effectiveness and consistency of the regulations were insufficient. As a solution, this study proposes expanding the provision of fair compensation and incentives. In addition, it proposes a method to protect national core technology-related patents from the filing stage by borrowing the handling procedures of defense-related patent applications. This study is expected to contribute to more effective regulation by compromising the nature of national core technology patents with those of national core technology.
