정신보건법에서 정신건강복지법으로의 개정과정에 나타난 담론형성과 사회변화 고찰 -보호담론에서 복지담론으로의 전환을 중심으로-

국문 초록

정신보건법은 제정 이래 정신질환자의 입원 및 치료과정에서 인권침해 문제가 지속적으로 제기되어 왔고 2017년 5월부터 전면 개정된 정신건강복지법이 시행되었다. 그러나 정신건강복지법 역시 개정 이래 다양한 집단의 대립의 중심에서 후속 개정 요구를 받고 있다. 법과 정책은 대립되는 가치관 속에서 무엇을 선택했는가의 결과이다. 이에 여전히 다양한 집단에 의해 개정논의가 지속되고 있는 정신건강복지법의 바람직한 개정 방향을 논의하기 위해, 정신보건법에서 정신건강복지법으로의 개정과정에 나타난 담론형성과 이것이 일으킨 사회변화에 대해 고찰하였다. 치료와 보호중심의 담론에 지배적 영향을 받은 정신보건법은 정신의료기관 병상 수, 강제입원의 비율, 정신의료기관 재원기간의 급격한 증가와 치료과정 중에서 인권문제를 발생시켰다. 이에 대판 비판으로 형성된 사회복지담론, 인권담론은 정신건강복지법 개정에 박차를 가했고 정신장애인 당사자집단의 참여를 통해 강제입원제도를 개선하고 차별해소와 복지서비스의 근거를 마련하였다. 정신건강복지법은 법 개정 목적에 따른 사회변화가 관찰되고 있다는 점에서 성과가 있었다고 평가할 수 있다. 그러나 몇몇 범죄사건을 통해 형성된 담론을 통해 개정 목적에 역행하는 재개정 요구가 나타나고 있어 주목할 필요가 있다. 우리는 과거 법 제정당시 정신질환자와 관련된 제도와 정책의 형성과정에 정신장애인 당사자가 참여하지 못한 현실과 정신질환자가 마음껏 치료받지 못하는 사회문화적 환경에 대해 비판적으로 바라보아야 한다. 국민의 정신건강증진 및 정신질환자의 인간다운 삶을 영위하는 데 이바지하는 정신건강복지법의 목적 달성을 위해, 당사자주의와 국가책임론을 향후 개정과정의 방향으로 제시하였다.

영문 초록

Since the enactment of the Mental Health Act, human rights violations have been continuously raised in the hospitalization and treatment process of mentally ill people, and the revised Mental Health Welfare Act has been implemented since May 2017. However, since the revision, the Mental Health Welfare Act has also been requested for further revision at the center of various groups confrontations. Laws and policies are the result of choices made in the midst of conflicting values. Therefore, in order to discuss the desirable direction of the revision of the Mental Health Welfare Act, which is still being discussed by various groups, the discourse formation in the revision process from the Mental Health Act to the Mental Health Welfare Act and the social changes it caused were examined. The Mental Health Act, which was dominantly influenced by treatment and protection-centered discourse, caused a sharp increase in number of beds in mental institutions, the rate of compulsory admissions to hospitalizations and the length of stay in mental institutions, and caused a human rights problem during the treatment process. As a result, social welfare and human rights discussions formed by criticism spurred the revision of the Mental Health Welfare Act, and improved the compulsory admission system through the participation of the people with mental disorder groups, and laid the groundwork for discrimination and welfare services. It can be evaluated that the Mental Health Welfare Act has been successful in that social changes are being observed according to the purpose of the amendment of the law. However, it is worth noting that the discourse formed through several criminal cases is showing request for a revision that runs counter to the purpose of the amendment. We should critically look at the reality that people with mental disorder did not participate in the formation of systems and policies related to people with mental disorder and the socio-cultural environment in which people with mental disorder were not treated to their heart s content. In order to achieve the purpose of the Mental Health Welfare Act, which promote the mental health of the people and contributes to the human life of the people with mental disorder , the Nothing About Us Without Us and national responsibility theory are presented as the direction of the future revision process.
