의사상자 지원제도 주요쟁점에 대한 고찰

국문 초록

본 논문의 목적은 타인을 위해 구조행위를 하다가 피해를 입은 의사상자 인정심의시 중요쟁점을 고찰하는 것이다. 의사상자 지원제도는 타인을 구조하기 위해 희생한 분들의 숭고한 정신을 고양하고 사회정의를 실현하는데 이바지하고자 하는 것이다. 또한, 그 희생과 피해의 정도 등에 알맞은 예우와 지원을 함으로써 그 유족과 가족에 대해서는 사회보장제도로서의 역할도 하고 있다. 요즘처럼 공동체 의식이 점점 희박해지고 개인주의적인 사회풍조가 만연된 사회에서 더욱 그 중요성이 커다란 제도이다. 따라서 제도의 성공적인 운영을 위해 중요한 점은 의사상자가 영예로운 자긍심을 가질 수 있도록 인정요건에 따라 엄격한 심의가 이루어지는 것이다. 본 논문에서 의사상자 인정심의시 주요쟁점에 대해 고찰한 결과, 현재의 ‘의사상자 등 예우 및 지원에 관한 법률’에서 정한 요건은 1970년 처음으로 법 제정시 정한 인정요건보다는 더욱 구체적인 규정으로 개정되었지만, 실제 이러한 인정요건을 심의하는 과정에서는 각 구조행위가 의사상자에 해당되는지 또는 아닌지를 판단하기가 쉽지 않은 것이 사실이다. 주요한 인정기준인 ‘직무 외의 행위’, ‘직접적 적극적 구조행위’와 ‘적용범위’와 관련된 쟁점은 직무계약시 맺은 직무행위의 구체적 범위, 외견상 표출된 구조행위의 적극성 여부보다는 구조행위와 밀접한 행위를 하는 과정에서 발생했는지 여부, 자신의 중대한 과실이 직접적인 원인으로 작용했는지 여부를 심도있게 심의하여야 한다.

영문 초록

The purpose of this paper is to analyze the major issues in the support system which was institutionalized to extol sublime virtues of persons who have sacrificed to rescue others and contribute to the realization of social justice. In addition, it plays a role as a social security system for the bereaved family and family members by providing proper treatment and support, according to the degree of their sacrifices and injuries and other relevant facts. It is an institution of salient importance in a society where the sense of community is becoming less common and individualistic social trends are prevalent. Therefore, an important point for the successful operation of the system is that strict screening should be conducted in accordance with the accreditation requirements so that the persons wounded or killed for a just cause can have honorable pride. In this paper, as a result of reviewing the major issues, it is true that in the process of deliberating these accreditation requirements, it is not easy to determine whether each rescue action meets any specific requirements or not. Issues related to the main accreditation criteria such as “job scope”, “direct and active rescue behavior” and “scope of application” should be judged in consideration of following three criteria: the specific scope of the job act at the time of the contract, whether it occurred in the process of carrying out an action closely related to the rescue action rather than the apparent activeness of the rescue action, and whether or not one s own serious negligence acted as a direct cause.
