인권 개념의 불교교육적 쟁점

국문 초록

근대의 인권 개념은 만민의 평등과 기본권을 확립한 점에서 인류 역사에 기여한 바가 적지 않다. 인권은 억압받은 약자들에게 인간으로서의 최소한의 자유와 권리를 의미한다. 그러나 인권의 혜택이 인간에만 제한될 경우 인간 이외의 생명에 대한 차별적인 권한으로 인식될 수 있다. 인권이 근본적인 인간의 권리라고 해도 서구적 인권 개념은 인간‘만의’ 권리라는 배타적인 성향을 부정할 수 없다. 불교에서는 인간이 가진 독점적인 권리로서의 인권을 인정하지 않는다. 인간에게 권리가 인정되려면 만물의 권리가 전제되어야 하고 만물의 권리 안에 인권이 부속될 뿐이다. 불교의 관점에서는 ‘인권(人權)’ 이전에 만물의 생명권(生命權)이 우선적으로 존중되어야 한다. 본 연구는 불교의 입장에서 인간중심적 인권 개념의 문제를 지적하고 교육현장에 적용할 수 있는 과제를 제시하고자 한다. 불교의 관점을 분명히 하기 위해 서구의 인권 개념의 한계를 대비하여 지적하고, 우리의 교육현장에서 문제가 되는 학생 인권의 문제를 논의하였다. 대학입학이 공교육의 목적으로 변질되어 있는 지금의 현실에서 학교 당국은 학생 인권의 보장에 관해 여전히 소극적이다. 미성년 시기에는 인권에 제한을 두어도 좋다는 인식은 인권 개념의 배타성이 여전히 존재하는 것이다. 청소년들이 인권 제한의 수동적인 대상이 아니라 인권 향유의 적극적인 주체임을 자각할 수 있는 지원이 필요하다.

영문 초록

The concept of human rights is said to be deeply rooted in the Western philosophy. In Western history, the development of the natural rights thinking established the modern basis for human rights of today. It is also known that the United Nations led the global efforts related to modern international human rights law. This distinction of human rights concept is useful in understanding specific contexts for the rights of human, which, in turn, would help understand and analyze the usage of anthropocentrism. There are discussions of human rights and rights of nature can be solved simultaneously by an ecological anthropocentrism. An ecological anthropocentrism tries to come true the ideas of security and realization of human Rights, on the other side acknowledge the importance of environmental preservation. But human rights concept of western history has a exclusive rights for human-itself. The aim of this paper is to show that there is a need for the human rights concept as a view of Buddhist education that based on life rights concept. In Buddhism, human has the same kinds of rights with the all creatures. There is no exclusive rights only for human in Buddhism. Violation of the student human rights in school has the problem at the same level of anthropocentric discrimination. So called progressives assert that we should protect our students’ rights from being suppressed due to the expansion of the rights. On the other hand, so called conservatives argue that there should be restrictions on some of the student human rights since they are still in the maturing stage. But there is unarguable thoughts that students has their own rights as a human being as well as all creatures.
