우리나라 스포츠관계법 정비 방안

국문 초록

국내 스포츠관계법 중에서 대회지원법을 제외한 6개의 문화체육관광부 소관 법률을 대상으로 전반적인 분석고찰을 통하여 효과적인 법체계를 확립하고 나아가 스포츠정책 운영 및 국민 스포츠 활동에 도움을 줄 수 있도록 정비방안을 모색한 결과 다음과 같은 결론을 얻었다. 첫째, 법제도 운영의 일관성 유지 및 효율성 제고를 위하여 스포츠관계법 간에 상호보완적으로 작용할 수 있도록 법률체계를 구축해야한다. 이를 위해서 스포츠기본법을 제정하고 이를 근거로 스포츠 개별법들이 제정되어야 한다. 현 국민체육진흥법은 장려법적인 성격에서 탈피하여 실체법으로서 기능을 발휘할 수 있도록 하고 체육기금에 관한 조항은 별도 법률로 분리 제정토록 한다. 또한 태권도진흥과 전통 무예 진흥 등 유사 성격의 법률은 통폐합되는 것이 바람직한 것으로 판단된다. 둘째, 용어개념상의 혼란을 방지하기 위해서 법상의 용어를 통일하여 사용해야한다. 이를 위해서는 스포츠와 체육의 용어를 현대 개념에 맞도록 스포츠 용어로 통일하도록 하고 국민체육진흥법, 체육시설의 설치이용에 관한 법률의 제명도 스포츠진흥법, 스포츠시설의 설치이용에 관한 법률로 개정되어야 한다. 또한 개념정립이 명확하게 규정되어 있지 않은 일부 용어에 대해서도 개념정의가 이루어져야 한다. 셋째, 변화하는 스포츠 환경을 수용하고 법률제정 목적을 달성하기 위해서는 다소 비논리적이고 실천의지가 미약한 법률은 정비되어야 한다. 이를 위해서 스포츠관계법을 검토한 결과 6개의 대상 법률 모두 개정되어야할 것으로 나타났다.

영문 초록

Nowadays, the sports related laws are strategically established in order for popularized, highly-developed, and industrialized sports to contribute health promotion, social welfare, social unification and nation s brand-power enhancement and to support the development of the relevant industries. Although these laws were enacted individually based on social circumstances and needs of the time of their establishment, the systematical operation of the laws has not well accomplished because their connectivity and relevance with the existing laws were not throughly examined. Furthermore, due to the fact that the laws couldn t properly reflect the volatile reality around the sports, many have expressed a concern that the laws lack consistency and effectiveness. In this paper, the modification directions for 6 sports related laws (the National Sports Promotion Act, Sports Industry Promotion Act, Traditional Martial Art Promotion Act, The Acts on the Taekwondo Promotion & Taekwondo Park Establishment, The Acts on the Installation and Utilization of Sports Facilities and the Acts on Cycle Racing and Motor Boat Racing) except temporary promotional laws were discussed. The results are as follows. First, the system of the laws on sports which guarantees consistency and complementarity among relevant sport laws should be established in order to promote their effectiveness. In order to do this, a fundamental law which acts as a parent law should be established, and based on this, relevant subordinate laws can be possibly enacted. For the National Sports Promotion Act which currently acts as a parent law, it should move away from its promotional tendency and be modified to function as a substantial law. The article on the Sports Fund in the Act causing the structural imbalance should be separated and established as an individual law. Moreover, those laws with similar functions, such as the Traditional Martial Art Promotion Act and the Taekwondo Promotion Act, should be combined. Second, law terms should be unified in order to prevent confusion. Those terms of sports and physical education based on the present laws should be unified as sport terminology, and the names of the existing laws should be modified according to sport terminology. For those terms with the lack of clear concept establishment, the lawful definitions should be provided. Third, those sport laws with insufficiency should be modified in order to be operated with their original purposes and objects. In order to accomplish this, the National Sports Promotion Act with the illogical structure of law system and those law with the lack of operational articles, such as the Taekwondo Promotion Act, the Traditional Martial Art Promotion Act, and the Sport Industry Promotion Act, should be modified. Additionally, the sports related laws, such as The Acts on the Installation and Utilization of Sports Facilities, should be modified in order to properly cope with changing sport environment.
