공익위원회 설치와 법제 개선 방향* - 정부 공익법인법 전부개정안과 해외 사례 비교를 중심으로 -

국문 초록

최근 공익단체에 대한 감독 강화의 목소리가 높아지면서 2021년부터 기부금단체 추천 및 관리가 국세청으로 일원화되었고, 기부자의 알권리 보장을 위해 기부자의 정보공개 요청에 대한 근거 규정도 마련되었다. 기부금단체에 대하여는 국세청, 기부금품 모집에 대하여는 행정안전부의 감독이 강화됨과 동시에 비영리법인 주무관청의 감독 역시 강화되고 있다. 이처럼 공익단체의 투명한 운영 및 효율적이고 통합적인 관리․감독과 지원에 대한 요구가 높아지고 있는 가운데, 법무부는 공익법인 총괄기구인 시민공익위원회를 설치하는 내용의 ‘공익법인의 설립․운영에 관한 법률 전부개정안’을 입법예고 하였고, 법제처 심사를 마쳤다. 정부 공익법인법 개정안은 시민공익위원회 설치, 시민공익법인에 대한 인정 및 관리감독, 시민공익법인에 대한 지원 등을 통한 시민공익법인의 건전한 운영과 활성화를 목적으로 하고 있다. 이에 대하여 공익법인 통합관리기구의 설치가 제안되었다는 점에 대한 긍정적인 평가에서부터 공익위원회의 설치 및 구성과 관련한 정치적 중립성 논란 등 다양한 논의가 이루어지고 있다. 본고는 공익위원회의 설치와 관련하여, 공익위원회의 구성 및 독립성, 공익법인의 범주와 인정방식, 공익위원회의 감독 범위와 형사처벌 제재 등의 쟁점에 관하여 정부 공익법인법 개정안과 영국, 호주, 일본 등 해외 입법례를 비교 검토하고 개선방안을 제시하였다. 아울러 공익법인에 대한 세제상 지원, 교육훈련이나 경비보조 등 운영지원, 기부금품 모집등록에 관한 특례 적용 등 공익법인 지원 정책에 관하여 정부 공익법인법 개정안 및 해외 사례를 비교 검토하였고, 공익법인 활성화에 도움이 될 수 있는 정책 방향을 제안하였다. 공익법인법 개정안에 대한 충분한 논의를 통해 영국, 호주 등의 해외 사례와 같이 공익단체의 활성화에 기여하고, 공익단체에 대한 사회적 신뢰를 쌓는데 도움이 되는 역할을 수행하는 위원회가 설립․운영될 수 있기를 기대한다.

영문 초록

The recent increase in calls for stronger supervision of public organizations has strengthened supervision of the National Tax Service, the Ministry of Public Administration and Security, and the competent authorities from 2021. In line with this trend, the Ministry of Justice pre-announced legislative amendments to the Act on the Establishment and Operation of Public Interest Corporations, which established the Civil Public Interest Committee, a general organization of public interest corporations. The amendment aims to strengthen transparency and revitalize public interest corporations through the establishment of a civil public interest committee jointly participated by the public and private sectors, unified recognition and supervision of public interest corporations, and support for public interest corporations. In connection, various discussions have been held, ranging from a positive assessment of the proposal for the establishment of an integrated management body for public interest corporation to a controversy over political neutrality related to the establishment and composition. The article compared the government s proposed amendments to the UK, Australia and Japan s legislation on issues such as the composition and independence of the Public Interest Committee, the category and recognition of public corporations, the scope of supervision and criminal punishment. Furthermore, this article compared government amendments and overseas cases on policies to promote public interest corporations, such as tax law support for public interest corporations, operation support for education and finance, and special application of fundraising registration. Based on the above, a policy direction that may be helpful for the revitalization of public interest corporations was proposed. It is hoped that the Public Interest Commission, which will be established based on the government amendment, will play a role in contributing to the revitalization of public interest organizations and building social trust in public interest organizations, as in overseas cases such as Britain and Australia.
