아동학대 대응 방안 실효성 분석

국문 초록

본 연구는 아동학대에 대한 실태와 원인을 살펴보고, 대응 방안의 실효성 및 예방 방안을 탐색하였다. 아동학대 피해 사건이 발생할 때마다 정부는 관련 법안을 강화하고 대응 방안을 제시해 왔다. 대표적인법안은 ‘아동학대범죄의 처벌 등에 관한 특례법’이다. 이와 같은 노력에도 불구하고, 아동학대 피해사례는 오히려 증가하고 있어 정부의 대응 방안에 대한 실효성에 대해 검토해 볼 필요성이 있다. 연구방법은 아동학대의 실태와 원인을 살펴보고, 이에 대한 정부의 대응 방안에 대해 살펴보았다. 또한 정부의 대응 방안의 실효성을 살펴보고, 관련 전문가들의 다양한 의견들을 바탕으로 실질적인예방 대책을 모색하고자 하였다. 연구결과는 다음과 같다. 아동학대의 원인은 개인 요인, 가족 요인및 사회적 요인으로 나누어 볼 수 있으며, 아동학대의 주 원인은 보호자의 양육태도, 양육기술 부족및 체벌이 용인되는 사회문화적 배경 등으로 나타났다. 아동학대는 대부분 신체학대, 정서학대 및중복 학대였다. 2021년 ‘아동학대 대응체계 강화 방안’은 다음과 같다. 첫째, 초기 대응의 전문성과이행력 강화다. 둘째, 대응인력 확충 및 업무여건 개선이다. 셋째, 즉각 분리제도의 차질 없는 시행이다. 넷째, 아동학대 처벌 강화 및 인식개선이다. 다섯째, 입양절차의 공적 책임 강화와 입양 지원 활성화다. 이에 대해 전문가들은 아동학대에 대한 지역사회의 역할을 강조하고 있다. 이와 더불어 아동 피해자가더 이상 발생하지 않도록 하는 대응책이 무엇보다 필요하다고 본다.

영문 초록

This study examined the actual condition and cause of child abuse, and explored the effectiveness and prevention of countermeasures. Whenever a child abuse case occurs, the government strengthens the related legislation and suggests countermeasures. The representative bill is ‘The Special Act on the Punishment of Child Abuse Crimes’, but the number of child abuse is increasing, so it is necessary to review the effectiveness of the government s countermeasures. This study examined the actual condition and cause of child abuse cases and examined the government s response to it. In addition, the effectiveness of the government s countermeasures was examined and practical preventive measures were sought based on various opinions of related experts. The results are as follows; The causes of child abuse can be divided into individual factors, family factors, and social factors. The main causes of child abuse are parenting attitude, lack of parenting skills, and permissiveness of sociocultural corporal punishment. Most of the child abuse was physical abuse, emotional abuse, and duplication abuse. The measure to strengthen the response system for child abuse in 2021 are follows; First, the enhancement of the expertise and performance of initial response. Second, to expand the response personnel and improve the working conditions. Third, to implement the immediate separation system without any hitches. Fourth, to strengthen the punishment of child abuse and improve the awareness. Fifth, to emphasize the public responsibility of adoption procedures and the activation of adoption support. The role of the community in child abuse should be emphasized by experts. In addition, countermeasures to prevent child abuse are needed.
