민법 개정작업에 대한 단상

국문 초록

우리 민법이 제정되어 시행된 이후, 그에 대해 적지 않은 입법론적인 제안이 있었으며, 그 대표적인 예가 2004년의 법무부 민법개정안과 2014년의 법무부 민법개정시안이다. 그런데 불행하게도 두 개정안의 입법적인 성과는 처음 작업을 시작할 때의 기대에 미치지 못하였던 것으로 보인다. 이러한 현실을 염두에 두고, 이 글은 2014년 민법개정시안의 물권편을 소재로 하여 ｢민법개정의 방향과 방법｣이라는 관점에서 민법 개정작업을 평가한다. 이를 위해 한편으로 민법개정시안이 신중하고 조심스러운 개정의 성격을 가지고 있음을 확인하면서 그 가능한 원인을 분석하고, 다른 한편으로 보다 구체적으로 취득시효와 근저당권 개정 내용을 비판적으로 검토한다. 동시에 개정작업의 입법화를 어렵게 한 외부적 사정요소들도 이후 개정작업에서 고려되어야 함을 지적한다. 이러한 개정작업의 경험을 비판적으로 공유함으로써 앞으로의 성공적 개정에 기여하고자 한다.

영문 초록

Since the Korean Civil Code took its effect, there have been a number of suggestions to its revision. Among them, two amendment drafts proposed by the Ministry of Justice, each in 2004 and 2014, particularly stand out in their scope and ambition. Sadly, however, their legislative success is deemed limited. Behind this background, this article attempts to evaluate the preparatory works for the 2014 amendment draft in its direction and method, focusing on its law of property part. It is at first made clear that many rules of the draft are in their approach and contents cautious, meaning that far-reaching amendments are rather few. Then this result’s possible causes are diagnosed, which is followed by two detailed analyses exemplifying it on the basis of the draft’s rules on adverse possession and maximum amount mortgage. Afterwards it is suggested that the social and political circumstances which are in the way of getting the draft through the Parliament have to be took in account as early as during preparing the amendment draft. This article could hopefully contributes to a critical communication of those who experienced the latest amendment process.
