국문 초록

우리나라는 2005년 본격적인 복지분권 사업이 추진된 이후부터 계속해서 중앙정부와 지방자치단체 간에 분권갈등이 지속되고 있다. 구체적으로는 지방자치단체의 복지재정 약화와 중앙정부 재정의존도 증가, 지방간 복지격차 확대, 중앙정부와 지방자치단체 사이의 복지권한의 갈등이 발생하고 있다. 이러한 갈등의 원인은 중앙정부와 지방자치단체 간의 복지사무를 둘러싼 권한배분과 책임의 문제가 자리하고 있다. 필자는 이러한 논쟁의 핵심이 「헌법」과 「지방자치법」으로 전환되어야 하고 법적 근본문제를 해소함으로써 해결될 수 있다고 판단한다. 따라서 「지방자치법」과 지방분권과 관련된 규범을 통한 법적 기초를 현실적으로 정립하여야 할 것이라고 본다. 그래야만 사회서비스 지방분권화가 정치공학논리를 넘어 실질화를 가능하게 할 수 있을 것이다. 이 논문에서는 사회서비스 지방분권화를 체계적으로 정립하기 위한 방안으로 첫째, 지방자치단체의 자치입법권 범위의 확대, 둘째, 확대된 자치입법권에 기반한 자주적 자치재정권 강화, 셋째, 명시적인 국가와 지방자치단체 간의 재정조정제도 도입을 주장했다.

영문 초록

The nation has been at odds between the central and local governments since the full-fledged welfare decentralization project was launched in 2005. As a result, are occurring weakening welfare finances of local governments, and increasing financial dependence on central governments, expanding welfare gaps between local and central governments, conflicting welfare rights between central and local governments in Korea. The cause of this conflict lies in the allocation of authority and responsibility over welfare work between the central and local governments. I believe that the core of this debate should be translated into the Constitution and the Local Autonomy Act . And this problem can be resolved by eliminating the legal fundamentals. Therefore, I believe that the legal basis through the Local Autonomy Act and the decentralization-related norms should be realistically established. Only then will decentralization of social services be made possible. In this paper, we propose the following method to systematically establish decentralization of social services. First, expanding the scope of autonomous legislative powers of local governments; second, strengthening autonomous financial powers based on expanded autonomous legislative powers; and third, introducing explicit fiscal coordination between central and local governments.
