인권관점에서 바라본 한국의 노인복지제도 변화

국문 초록

본 연구는 인권의 관점에서 한국의 노인복지제도의 변화를 살펴보고자하였다. 현재 한국의 노인은 심각한 빈곤상태에 직면해 있다. 2019년 고령자통계에 따르면, 고령자 중 연금 수령 비율은 절반에도 못 미치는 45.9%에 그쳤고, 연금수령자들의 월평균 수령액은 61만원인 것으로 조사되었다. 신체적, 정신적 노화로 인해 노동시장에서 적극적인 근로활동을 수행하는데 어려움이 있고, 전통적인 노인부양의식이 소멸해가며, 전적으로 가족부양을 책임졌던 여성이 노동시장에 편입되면서 돌봄의 책임은 국가로 이동하게 되어, 빈곤문제를 가지고 있는 노인은 이제 스스로 극복하기 어려운 현실에 놓이게 되었다. 오늘날 인권의 발달단계는 사회적 보호를 필요로 하는 소수자의 권리옹호활동과 인권보장을 위한 노력인 1세대 인권에서 공공과 민간에 의한 직접적 서비스를 제공하는 과정으로 이해되는 2세대 인권을 거쳐, 기존의 개인적 수준이 아닌 집단적 수준의 권리인 3세대 인권으로 인식되고 있다. 이는 지난 노인복지제도의 역사 속에서 우리는 탄압 패러다임에서 웰빙 패러다임으로의 전환이 되었음을 확인할 수 있었다. 따라서 웰빙 패러다임이 지배하는 현재 생애주기에 놓인 노인이 주체로서 완성되기 위해서는 노인복지실천에서 인권관점을 기반으로 한 급여나 서비스가 제공되기 위해서는 노인인권보호를 위한 법률이 제정되고 정비되어야 한다.노인복지법을 개정하여 ‘권리로서의 복지’의 성격을 보다 분명히 하고 노인차별 금지와 인권보호에 관한 구체적인 조항을 신설하여 노인인권을 보호하기 위한 법적·제도적 기반을 구축해야 한다. 노인복지정책의 목표에 ‘노인의 삶의 질 향상과 권익보호’를 명기하고, 소득보장, 주거보장, 고용보장, 건강보장, 사회서비스 등 모든 세부 영역에서 인권관점을 기반한 정책이 개발되고 집행되어야 한다.

영문 초록

In these days, elderlies are facing severe poverty in Korea. According to the elderlies statistics, among elderlies, pension receiving ratio is less than half, being 45.9% as of now. The average amount of pension received was 610,000 won per one month. They are hard to participate in labor market due to physical and psychological aging. As traditional mind for elderly care diminishes, and as the woman who had taken care of the elderly became to be part of labor market, the responsibility of elderly care is now on the government. This makes the elderlies in poverty unable to make living by themselves. In these days, human right development has come to its 3rd stage. At the 1st stage of haman right, efforts were made to take care of the minorities in need of social care and to protect human right. At the 2nd stage of human right, service was directly provided by the public and civil sectors. And at the 3rd stage now, human right is not perceived as an individual right like before, but as a collective right. Like this, we could understand that, in the history of welfare system for elderly, paradigm has shifted from oppression paradigm to well-being paradigm. In that regard, for the elderly to become the principal agent in these days of well-being paradigm, and for providing pensions and services on the human right perspective while realizing elderly welfare, the laws for elderly human right protection must be legislated and rearranged. Elderly Welfare Act needs to be amended to make it clear that the welfare is the right, and to newly provide specific clauses for elderly discrimination prevention and human right protection, thereby setting up a legal and institutional ground for elderly human right protection. In the object of elderly welfare policy, it must be stipulated that the elderly s life quality should be enhanced and their human right must be protected. And the policy must be developed and executed on the perspective of human right in all specific areas including revenue, housing, employment, health and social services.
