수용자 자녀 권리보장을 위한 국내 제도 개선방안 연구 -사례분석을 중심으로-

국문 초록

본 연구는 수용자 자녀의 권리 침해 사례를 통해 국내 제도를 살펴보고 이를 통해 수용자 자녀 권리보장을 위한 정책적 개선방안을 제시하는 데 목적이 있다. 연구대상은 현재 부모가 수감되어 있는 청소년이며 그들이 경험한 권리 침해 경험을 확인하여 유엔아동권리협약의 4가지 권리에 맞추어 분석하였다. 동시에, 국내 제도를 적용하여 검토하였다. 그 결과 어떤 조항에서도 수용자 자녀의 정의나 용어는 제시되지 않았다. 아동복지법과 한부모가족지원법, 기초생활보장법, 긴급복지지원법에서 부모의 수용은 부양의무자나 보호자의 부존재로 인정받아 수용자 자녀는 지원 대상에 포함 되고 있는 것이 확인되었다. 그러나 각 법률 내에서 수용자 자녀 지원을 위한 내용과 수용자 자녀가 겪는 여러 고충을 해결하고자 하는 시도는 부족한 것으로 나타났다. 특히 체포나 구금단계에서 자녀 보호를 위한 근거는 존재하지 않았고 형의 집행 및 수용자 처우에 관한 법 개정으로 부모접견과 아동지원의 근거가 마련되었지만 구체적인 실천내용들이 마련 될 필요가 있음이 확인되었다. 이러한 연구결과를 바탕으로 수용자 자녀 지원을 위한 관련법의 재정비, 수용자 자녀 국가 통계구축을 위한 규정마련, 수용의 단계와 아동권리 영역에 따른 수용자 자녀 지원 정책 마련, 법적 접근성을 강화시키기 위한 실질적인 조치들을 제안하였다.

영문 초록

The purpose of this study is to examine the domestic system through cases of infringement of the rights of the children of the prison and to present policy improvement measures to ensure the rights of the children of the incarcerated. The study target is a teenager whose parents are currently in prison. Their experience of rights violations was identified and analysed in accordance with the four rights of the UN Convention on the Rights of the Child. At the same time, the domestic system was applied and reviewed. As a result, no clause presented the definition or term of the acceptor s child. Under the Child Welfare Act, the Single Parents Family Support Act, the Basic Livelihood Security Act, and the Emergency Welfare Assistance Act, it was confirmed that parental acceptance was recognized as an absence of dependents or guardians, and that children of the incarcerated were included in the application list. Within each law, however, attempts to address content to support the children of the incarcerated and various hardships experienced by the children of the incarcerated have been found to be insufficient. In particular, there was no evidence for the protection of children during the arrest or detention phase, and although the revision provided the basis for parental access and child support, it was confirmed that specific actions were needed. Based on the results of these studies, practical measures were proposed to readjust the relevant laws to support the children of the acceptor, to establish national statistics for the children of the acceptor, to prepare policies for supporting the children of the acceptor and to enhance the legal accessibility of the acceptor in accordance with the phase of acceptance and areas of child rights.
