국문 초록

미국의 직업재활 및 장애인복지서비스의 전반적인 내용을 규정한 미국재활법(The Rehabilitation Act)은 미국장애인법(Americans with Disabilities Act: ADA)과 함께 미국의 2대 장애인재활 관련법으로 인정받고 있다. 미국재활법은 장애인에게 시민으로서의 기본적인 권리를 부여하고, 장애인을 비장애인과 함께 주류 사회에 통합시키는데 궁극적인 목적을 두고 있다. 이러한 목적을 달성하기 위하여 미국재활법에는 직업재활과 지원고용, 독립생활, 내담자원조, 재활공학 등의 서비스를 위한 공식 지원프로그램이 규정되어 있고, 재활서비스청(RSA)에서 시행하는 다양한 훈련 및 서비스 지원제도도 들어 있다. 동 법에는 또한 국립장애 및 재활연구소(NIDRR)에서 수행하는 연구 활동과 국가장애평의회(NCD)의 활동도 규정되어 있고, 장애인의 인권과 권익옹호 및 보호에 초점을 맞춘 다양한 조항들도 포함되어 있다. 그러나 우리나라에서는 아직 미국재활법에 대한 소개가 거의 없는 상황이고 따라서 이 법이 담고 있는 장애인 위주의 여러 가지 재활원리들이 소개되어 있지 못한 실정 이며, 앞으로 보다 내실 있는 장애인재활사업을 추진하기 위해서는 이에 대한 이해가 절대적으로 필요하다. 따라서 본고에서는 미국재활법에서 제시하고 있는 재활원리와 서비스체계, 변천사, 주요 내용, 제한점 등을 소개함으로 아직 체제가 제대로 갖추어 지지 않은 우리나라 장애인재활체계를 정립하기 위한 기본적인 토대를 제공하고자 한다.

영문 초록

The Rehabilitation Act which introduces vocational rehabilitation and welfare services for Americans with disabilities is recognized as one of two major pieces of disability legislation along with Americans with Disabilities Act(ADA, 1990). The Rehabilitation Act aims to bestow civil rights to persons with disabilities and integrate them into mainstream society. To achieve this objective, the Act introduces public support services for vocational rehabilitation, supported employment, independent living, client assistance, and rehabilitation engineering. It also introduces various training and support services administered by Rehabilitation Service Administration(RSA). Research programs in National Institute on Disability and Rehabilitation Research, activities of National Council on Disability, and various articles focusing human rights and advocacy for people with disabilities are listed in this Act. However, the content of the Rehabilitation Act and rehabilitation principles focused on persons with disabilities were not properly introduced in Korean field of rehabilitation. We need to understand the objective and major issues of the Rehabilitation Act to deliver effective and efficient rehabilitation services to people with disabilities in Korea. The aim of this study is to introduce rehabilitation principles, service delivery system, legislative history of rehabilitation, major issues and limitations of the Rehabilitation Act in order to provide basic foundations of rehabilitation service system in our country.
