부산광역시 사회복지사 등의 처우 및 지위향상에 관한 조례 분석

국문 초록

사회복지사의 역량이 곧 서비스의 질을 좌우하게 되는 사회복지서비스에서 사회복지 관련 종사자의 처우 및 지위 향상은 반드시 해결해야 할 과제이다. 추상적 선언에 그치고 있는 「사회복지사 등의 처우 및 지위 향상을 위한 법률」을 구체화하기 위해서는 자치입법인 「사회복지사 등 처우 및 지위향상 조례」를 통한 실질적인 개선이 필요하다. 본 연구에서는 사회복지 종사자의 처우 및 지위향상을 위한 법적환경이 마련되었음에도 처우가 개선되지 않고 특히 지방자치단체별 차이가 드러나지 않는 것이 조례에도 나타나고 있다고 보았다. 따라서 부산광역시의 사회복지사의 처우 및 지위향상에 관한 조례(본청과 12개 구·군)의 내용을 비교하고 분석하여 개선점을 제시하여 추후 제·개정될 조례를 위한 초석을 제공하고자 한다. 연구 결과를 통한 제언으로 첫째. 조항의 의무성을 더욱 높여 조례의 강제성을 도모하여야 한다. 둘째. 일률적이고 제한적인 조례 내용을 지역적 특성에 따라 구체화하기 위한 노력이 필요하다. 셋째. 사회복지사 직무환경에 대한 책무 및 업무의 명확화가 필요하다. 넷째. 시설별, 지역별 차이를 고려한 인건비 가이드라인을 제시하여 준수 의무를 강화시켜야 한다. 다섯째. 사회복지사의 처우 및 지위 향상이 실질적으로 실현될 수 있도록 간사를 비롯한 인력 배치의 중요성을 확대해야 한다. 부산광역시 시․군․구가 이러한 내용을 반영한 「사회복지사 등 처우 및 지위향상 조례」의 제·개정을 토대로, 일선 현장에서 활동하는 사회복지서비스 제공자인 사회복지사의 역량 향상 도모 또한 필요하다. 이는 결국 사회복지사의 역량 뿐 아니라 서비스의 질 또한 향상되어 서비스를 받는 대상자의 욕구 또한 충족될 수 있는 선순환을 기대할 수 있을 것이다.

영문 초록

The competence of the social worker are linked to the quality of the social welfare service, the improvement of the status of the social workers must be solved. In this study, the act also observed that even though the legal environment for social welfare workers treatment and status improvement was provided, the treatment did not improve especially even the ordinances do not reveal the difference by local governments. Therefore, we intend to compare and analyze the contents of the ordinance on social workers treatment and status improvement in the Busan Metropolitan City to provide a cornerstone for the ordinance to be enacted or revised later. The findings based on analysis are as follows. First, the mandatory nature of regulations must be strengthened to enhance the enforcement of the ordinance. Second, a uniform and limited ordinance should be specified according to local characteristics. Third, it is necessary to clarify the responsibilities and tasks of the social worker s job environment. Fourth, personnel expense guidelines considering differences between facilities and regions should be presented to reinforce their obligation to comply. Fifth, the importance of manpower arrangements, including assistant administrator, should be expanded to enable the realization of the treatment of social workers and improvement of their status. Through the revision and improvement of the ordinances of all cities, counties, and districts in Busan, the social workers capacity should be improved. In the end, not only the capacity of the social worker but also the quality of service will be improved and it is expected to create a virtuous cycle that can satisfy the needs of the service target.
