국문 초록

오늘날 복지전달체계가 어떻게 구성되느냐에 따라 가장 효과적인 복지효과 달성 및 효율적인 예산 집행이 가능하다. 이러한 복지전달체계의 중요한 하나의 방안이 사회서비스 이용권제도이다. 이러한 사회서비스 이용권과 관련하여서는 「사회서비스 이용 및 이용권 관리에 관한 법률」(이하 「사회서비스 이용권법」)에 법적 근거를 두고 있다. 「사회서비스 이용권법」은 주로 제재규정을 통한 수급의 적정화를 도모하거나 거버넌스적 측면의 개선을 통한 사회서비스 이용권의 효율적 운영 강화를 도모하거나 도모하고자 하고 있다. 또한 「사회서비스 이용권법」은 사회서비스 이용권 종사자에 관한 인권보호 및 처우 개선과 관련하여서도 많은 논의가 있어 왔다. 그러나, 사회서비스 이용권 종사자에 대한 인권보호 및 처우 개선과 관련하여 입법적인 개선도 중요하지만 이와 관련한 예산 확보 및 제도 운영의 엄격함이 필요할 것이다. 그리고, 현행 「사회서비스 이용권법」이 법체계적인 측면에서 위임사항에 대한 문제점의 개선이 필요하다고 보인다. 이러한 문제를 해결하기 위해 위임사항에 대한 검토 과정을 거쳐 대통령령으로 위임할 사항과 보건복지부령으로 위임할 사항을 정리할 필요가 있을 것이다. 향후 정부에서 발표한 사회보장 정보전달체계 개편 기본방향에 대해 「사회서비스 이용권법」이 제도 개선이 되어야 할 것인지에 대해서도 검토할 필요가 있을 것이다.

영문 초록

Today, achieving the most effective welfare effect and executing efficient budget are dependent on how a welfare delivery system is designed. One of important plans for the welfare delivery system is social service voucher system. This social service voucher is legally based on 「Act on the Use of Social Services and the Management of Vouchers」(hereinafter called 「Social Service Voucher Act」). The purpose of 「Social Service Voucher Act」 is to balance supply and demand through regulations, to enhance efficient operation of social service vouchers through the improvement in governance aspects. In terms of 「Social Service Voucher Act」, there have been a lot of discussions on the protection of human rights for social service voucher workers and on their treatment improvement. Relevant legislative improvements are important. Moreover, it is necessary to secure a relevant budget and strictly operate a relevant system. In addition, it is necessary to solve the problems of authorized matters in terms of the legal aspects of the current 「Social Service Voucher Act」. To do that, it is required to review authorized matters and divide them into those authorized by the Presidential decree, and into those authorized by the decree of Ministry of Health and Welfare.
