국문 초록

우리나라는 2009년 군인복지기본법 시행 이후 군사회복지에 대한 체계가 정비되기 시작되었다고 볼 수 있다. 국군은 헌법에 의하여 국가의 안전보장, 국토방위의 의무 수행을 하여야만 하고, 헌법상 정치적 중립성을 지켜야 하는 특수한 신분을 가진다. 이에 다른 공무원과도 일부 구분되고 직무의 특성상 여타의 직업군과는 차별화되는 면을 지니고 있다. 일가정 양립의 경우도 마찬가지라 할 수 있다. 이에 본 연구는 군인을 대상으로 한 일가정양립 정책 관련 법률을 분석하여 현 군복지정책의 체계와 향후 나아갈 방향에 대하 논하고자 한다. 연구 방법은 법률의 질적 내용 분석(contents analysis)을 중심으로 하되, 통계 자료를 활용하여 군 복지의 현황을 파악한다. 연구 대상은 군인복지기본법을 비롯한 관련 법률을 대상으로 한다. 특히 최근 군인의 일가정 양립 현황 관련 법률 분석을 시도하는데, 근로기준법, 남녀고용평등법, 영유아보육법 등의 유관 법률 등과의 비교를 통하여 군인을 대상으로 한 법률 구조의 특이점, 개선점 등을 도출한다. 연구 결과, 최근 군인을 대상으로 한 일가정 양립 정책은 많은 변화를 겪고 있는 것으로 파악된다. 그 중에서도 저출산 해소 정책의 내용을 군 영역 내에서도 상당 부분 반영하고 있는데, 향후에는 군의 특성을 반영한 고유한 내용을 통해 군 욕구에 부응하고, 현실 적합한 정책을 개발하는 데 더욱 노력을 기울여야 할 것으로 판단할 수 있다. 본 연구는 문헌 연구에만 그친 한계를 가진다. 차후에는 현실적인 욕구 조사를 통해 본 연구를 발전시키고자 한다.

영문 초록

Since the implementation of the Basic Act on the Welfare of the Army in 2009, the system for the military social welfare has begun to be improved in Korea. The Armed Forces must have a duty to fulfill the obligations of national security and homeland defense under the Constitution, and have a special status in the Constitution to maintain political neutrality. Therefore, it is distinguished from other civil servants and it has different aspects from other occupational groups due to the nature of the job. However, in the area of welfare, the welfare policy needs to be designed in consideration that the soldier is a citizen of the Republic of Korea who has basic human rights before his obligation to the state. The purpose of this study is to analyze the welfare policies related to the military and to discuss the current system of welfare policy and its future direction. In particular, we will discuss the issue of the work-family balance policy. The research method focuses on the contents analysis of the law, but it uses statistical data to grasp the status of military welfare. The subjects of the study are related laws including the Basic Law of Military Welfare. In particular, recent attempts to analyze the legal status of the military reconciliation status of the soldiers are conducted through comparison with the related laws such as the Labor Standards Act, the Gender Equality Employment Act, and the Infant Care Law. As a result of the study, it is concluded that the policy of reconciliation of working and family for soldiers recently is undergoing many changes. In particular, the content of the low birthrate policy is reflected in the military area. In the future, it will be necessary to make more efforts to meet the needs of the military through the contents reflecting the characteristics of the military, Can be. This study has limitations only in the literature study. In the future, we intend to develop this research through realistic desire survey.
