주거기본법의 한계와 개정방안

국문 초록

이전의 우리나라의 주거정책은 시장을 통한 주택의 물량확대 위주의 공급을 해왔으나 영구임대주택을 시작으로 공공임대주택의 확대와 주거급여의 실시 등 주거복지정책이 확대되어왔다. 이러한 주거복지정책의 확대는 대상자들의 주거안정에 기여해 온 바 크다. 그러나 이러한 정책은 예상하지 못한 결과도 초래하였다. 대규모 아파트 형태로 공급된 공공임대주택 단지에서는 소란, 음주, 고독사, 단지 안의 활력 없음 등 여러 문제가 나타나고, 단지 외부와 관련해서는 지역사회와의 관계단절, 고립, 낙인 및 사회적 배제라는 현상이 나타나고 있는 것이다. 이러한 문제는 단순히 주거에 초점을 둔 주거복지 만으로 해결하기 힘들다. 따라서 기존의 주거복지 외에 지역사회와의 관계망 형성 및 사회서비스 등 관련 사회복지적 대책이 함께 진행되어야 이러한 문제 해결에 도움을 줄 수 있을 것이다. 이러한 문제의식 속에 본 연구에서는 우리나라 주거복지정책의 법적 근거가 되는 주거기본법을 대상으로 그 한계와 개정방안을 논의하였다. 우선, 주거복지의 개념에 관한 논의에서는 주거복지가 물리적 주거만의 문제가 아니라 사회적 관계와 관련 서비스까지 고려해야 한다는 점을 확인하였다. 이후, 노숙인 등을 대상으로 지역사회 정착을 위한 매입임대주택 등 최근의 주거복지정책의 현황을 검토하였으며, 현실 주거복지정책의 근간을 이루는 주거기본법의 내용을 위와 같은 관점으로 살펴보았다. 이에 따라 주거기본법의 주거복지 조항들을 소개하고 이에 대해 주거복지가 지역사회와의 연계, 사회서비스 등 사회복지적 대책과 함께 제공되어야 된다는 관점에서 각 조항의 문제점을 검토하고 개정방안을 제시하였다.

영문 초록

Previously, Korea s housing policy has focused on expanding the volume of housing through the market, but housing welfare policies have been expanded, including permanent rental housing, public rental housing and housing benefits. The expansion of housing welfare policies has contributed to the stability of the residents. However, these policies has also led to unexpected results. In the public rental housing complex supplied in the form of a large apartment, there are various problems such as disturbance, drunkenness, solitude, lack of vitality in the complex, and there are problems that arise as a result of external disconnection, isolation, stigma and social exclusion. These problems can not be solved simply by housing welfare focusing on housing. Therefore, besides existing housing welfare, related social welfare measures such as formation of network with community and social service should be accompanied to help solve these problems. In this study, we discussed the limitations and the revision plan of the Housing Basic Law, which is the legal basis of the housing welfare policy in Korea. First, in the discussion on the concept of housing welfare, it was confirmed that the housing welfare should consider not only the physical housing but also the social relation and related services. After reviewing the present state of housing welfare policies such as purchase rental housing for the settlement of the local community to the homeless, the contents of the Housing Basic Law, which forms the basis of the actual housing welfare policy, were examined from the above viewpoint. Therefore, the housing welfare provisions of the Housing Basic Law are introduced and the problems of housing welfare should be provided with social welfare measures such as linkage with the local community and social welfare including related social services.
