독일 아동보호체계 분석과 한국에의 적용가능성

국문 초록

아동학대 범죄의 처벌 등에 관한 특례법의 시행은 현장조사의 개입과 일시보호, 그리고 가정법원을 통한 친권의 개입 등 아동보호체계를 강화하고 있다. 하지만 법과 현장에서의 실효성문제가 여전히 제기되고 있다. 이에 본 연구는 독일의 아동보호체계를 법과 구조적 관점 내에서 분석하고 한국에의 적용가능성을 연구하였다. 독일과 한국이 비교되는 점은, 첫째로 학대판정이 서비스제공에 필수적 조건인지에 대한 여부이고, 둘째로 가족의 자율성과 국가의 통제의 쟁점, 셋째, 아동보호 체계 내에서 담당기구의 적합성 문제, 넷째, 사례판정 이후 서비스 지원의 범위 문제, 마지막으로 아동보호 프로세서의 역할문제이다.

영문 초록

The implementation of the special act concerning the punishment of crimes of child abuse strengthens the child protection system with the intervention of field investigation, temporary protection, and invervening in the parental rights through family court, etc. However, this law is still questioned about it s effectiveness. therefore, child protection system in Germany is analyzed by structural aspect of the law and its applicability in Korea was researched in this study. This study suggests some different about the system between korea and Germany. First, if the judgment of the abuse is an essential condition to provide the service. Second, issue between family autonomy and cortrol of the country. Third, the role of central hub of case management. Fourth, the scope of the service after judgment of a case. and the last issue is, the role of the process of the child protection.
