사회복지법제 교육의 현황과 개선방안

국문 초록

사회복지법제론은 교수와 학생 모두가 부담스러워 하는 교과목으로 인식되었고, 사회복지법제 교육 필요성에 대한 인식 부족 등으로 교육 현장에서 제공되고 있는 사회복지법제 교육은 부실할 수밖에 없었다. 이에 본 연구는 사회복지법제 교육 현황을 진단하고 그에 따른 개선방안을 제시하여 사회복지법제 교육에서 무엇을 가르쳐야 하는지를 탐색하는데 그 목적이 있다. 본 연구를 위하여 2012년 한국사회복지교육협의회 교과목 지침서에서 제시한 내용과 분석을 위하여 선정된 9개의 사회복지법제론에 수록된 내용을 비교 분석하였다. 연구 결과 다음과 같은 문제점이 나타났다. 첫째, 사회복지법제의 총론으로서 사회복지법제 기초 지식과 이론적 부분이 미흡한 수준으로 사회복지법을 해석하고 적용하는 능력을 배양할 수 없는 수준이었다. 둘째, 사회복지법제의 각론으로서 개별사회복지법은 법률 내용만을 나열하는 수준이며, 그 범위가 변화하는 사회복지법제 환경을 반영하지 못하고 있었다. 이에 따라 개선방안을 다음과 같이 제시하였다. 첫째, 사회복지법제 총론 부문에서 사회복지법이 지닐 수 있는 특성을 강화할 필요가 있다. 둘째, 판례 및 사회복지법리에 대한 교육을 강화할 필요가 있다. 셋째, 사회복지법과 관련법을 분석하고 해석할 수 있는 사회복지법 방법론 교육을 강화할 필요가 있다. 넷째, 사회복지법의 범위를 재설정해야 한다. 다섯째, 사회복지법제 각론의 개별 사회복지법에 대한 교육방법을 모색해야 한다. 여섯째, 사회복지법제 교과목을 가르치는 교수의 역량을 높이기 위한 특별 교육프로그램을 사회복지법제학회와 한국사회복지교육협의회가 공동으로 운영할 필요가 있다.

영문 초록

Social welfare law courses have come to be regarded as burdensome by both students and instructors alike, and, and the lack of the need for the education of social welfare law, which is being provided in the academic field, has resulted in inadequate levels of such education. Motivated by this fact, this study aims to assess the current state of social welfare law education, and to propose some possible measures for improvement, which includes exploring what should be taught in said courses. We analyzed and compared the contents of the 2012 curriculum guidelines set out by the Korean Council on Social Welfare Education with those of nine social welfare law courses currently being provided. Through the analysis, we identified the following issues: First, in introductory courses on social welfare law, the treatment of basic concepts and theoretical aspects are inadequate. Consequently, courses are unable to nurture the capacity for the interpretation and application of social welfare laws. Second, on the subtopics of social welfare law, courses often simply enumerate the individual laws, without reflecting the changing environment in which social welfare laws operate. In view of these problems, we propose the following possible measures for improvement: First, it is necessary to emphasize the potential particularities of social welfare laws in the introductory part of the courses. Second, there is a need to strengthen the instruction of judicial precedents and jurisprudence of social welfare laws. Third, methodology training must be strengthened in order to nurture the ability to analyze and interpret social welfare and other related laws. Fourth, the scope of social welfare laws must be redefined. Fifth, better education methods for the subtopics of social welfare laws must be considered. Sixth, special training programs for enhancing the competence of social welfare law instructors should berunjointlybytheKoreanAcademyofSocialWelfareandLawandtheKoreanCouncilonSocialWelfareEd ucation.
