국문 초록

본 연구는 전북대학교 박물관소장 조선시대 토지매매명문 2,300여건 가운데 배면에 기록이 남아 있는 601건을 대상으로 문서의 보관과 관리라는 측면에서 접근한 연구이다. 매매명문의 배면에는 문서소장자가 문서를 효율적으로 관리하기위한 기록이 남아있다. 그 내용은 문서의前面에 쓰여 있는 거래 내용 이외의 다른 정보들을 담고 있다. 배면에 남아있는 기록의 유형과 내용, 위치 등을 검토하여 문서 소장자가 문서의 배면을 어떻게 활용 보관하였는지에 대해 검토하였다. 토지매매명문의 배면 기재 유형은 크게 두 가지 유형으로 나누어 볼수 있었는데, 이것은 문서를 접는 방식과도 관련이 있다. 문서를 직선네모 방식으로 접은 것은 유형A로 분류하였다. 유형A의 기재요소는 대체로[소재지+면적+지목]을 기본으로 한다. 이러한 기재방식은 前面의 명문 내용과 주요정보에 대한 간략기재방식이라고 할 수 있다. 유형B는 문서를 사선네모 방식으로 접은 것으로, 유형A의 기재요소 외에도 추가적인 정보가 더 있다. 즉 거래를 중개한 ‘居間’, ‘興成’, ‘勸買’인의 이름, 그리고 중개수수료에 해당하는 ‘成語’, 실제 경작을 맡은 作人의 이름, 그리고 매년 내야 할 賭租의 액수 등이다. 토지의 거래를 중개한 ‘거간’은 처음부터 수수료를 목적으로 하는 중개는 아니며, 이들은 주로 농민으로, 이들이 중개를 하는 목적은 그 토지의 作人이 되고자 하든가, 혹은舍音이 되기를 바라든가의 이유에서였다. 또한 중개수수료는 거래 가격이나 거래면적과는 상관없었다. 이 방식은 거래에 대한 세부정보를 보충하여 기재하는 방식이라고 하겠다. 이외에도 별도의 띠지를 두르는 방식이나, 종이끈으로 묶는 방식이 있다. 이 검토를 통해 조선후기 전라도, 주로 求禮, 南原, 同福縣의 토지거래의 보다 구체적인 모습을 살펴 볼 수 있었다. 이처럼 일반적으로 지나치기 쉬운 문서의 배면, 혹은 전면에 있는 메모 형식의 기록에도 좀더 주의를 기울일 필요가 있다는 점을 강조하고 싶다. 이는 문서의 촬영이나 보수에 있어서도 마찬가지 이다.

영문 초록

This is a study of the preservation and management of the 601 endorsed contracts among the 2,300 land trade contracts of the later Joseon collected by Chonbuk National University Museum. There remain endorsements on the back of the contracts which contract collectors wrote to keep them efficiently. The endorsements contain more details other than the basic information written on the contract. The types, contents, and the positions of the endorsements have been examined to find out how the collectors used and preserved the back sides of the contracts. The types of endorsements, which are written on the back of land contracts, are divided largely into two types, which are closely related to their folding ways. Contracts folded straightly are classified as the A type, which basically have the addresses, sizes, and categories of the properties. Actually, this contains the brief summary of the contracts. Meanwhile, contracts folded diagonally are classified as the type B , which have more information other than the brief summary, including all the related things and persons such as the real estate agent, haggling, the advisor s name who recommended the conditional purchase, brokerage, farmer s name who actually farmed in that land, and tax money the owner had to pay each year. Most of the agents in the documents were farmers. The commission wasn t their prior aim. They were the farmers, so their aim was to rent the land to farm or to be the landowner s agent. In addition, the commission was not relevant to the prices or sizes of the land. To make it short, the type B is to make up for details which couldn t be written on the contract. Besides these two types, there were two more types; one is to put wrappers around the contracts, and the other type is to bind the contract with paper cords. Through this study, more concrete aspects of land trade in Gurye, Namwon, Dongbok Hyeons of Jeolla-do in the later Joseon could be examined. As a writer of this paper, I d like to emphasize the fact that it is necessary to pay more attention to the endorsements or small memos even on the contract which could be easily ignored. I think more careful access is needed as well when the documents are taped, photographed, or restored.
