Exploring Modern Corporate Anti-Fraud Systems from a Comparative Law Perspective

국문 초록

With the deepening development of the market economy, corporate compliance has become a key factor and important guarantee for the stable operation and sustainable development of enterprises. How to strengthen corporate compliance and prevent and contain fraud events in the current complex and volatile market environment can be analyzed from the perspective of anti fraud, through comparative law, combining foreign law and domestic law, in terms of pre prevention and post investigation. Enterprises need to establish an anti fraud criminal compliance system in a timely manner, combine existing institutional requirements with the top-level design of the country, strengthen anti fraud education, and implement criminal compliance in every aspect of the production and operation process. At the same time, it is necessary to strictly follow the requirements of the regulations, conduct in-depth investigations into possible improper behaviors, promptly recover losses, hold relevant personnel accountable, and transfer suspected illegal personnel to the public security organs. Based on the investigation results, corresponding corrective measures should be taken to prevent similar incidents from happening again.

영문 초록

市場経済の深化に伴い、企業のコンプライアンスは企業の安定経営と持続的発展の鍵となる要素であり、重要な保障となっています。現在の複雑多変な市場環境下で企業コンプライアンスを強化し、不正行為の発生を予防と抑制するためには、反不正行為の理念から出発し、比較法の視点を取り入れて、外国法と中国法を結合し、事前の防止と事後の調査の両面から分析を行うことができます。企業は迅速に反不正行為の刑事コンプライアンス体系を構築し、現行制度の要求と国家のトップデザインに基づいて、反不正行為教育を強化し、企業の刑事コンプライアンスを生産経営過程の各層面に実施する必要があります。同時に、規章の要求に厳密に従い、不正行為の可能性がある場合には深入的な調査を行い、損失を迅速に回収し、関係者の責任を追及し、違法行為が疑われる者は公安机关に移送し、調査結果に基づいて適切な改善措置を講じて、同様の事件の再発を予防する必要があります。
