국문 초록

The economic system ensures continuous operation within the system by eliminating and rebuilding scarcity. However, under the influence of scarcity manifestations led by currency, the mutual influence between trading entities is formed and continuously expanded through markets and organizations, even beyond the control of the economic system. This requires the institutionalization of communication regarding scarcity. This study uses Luhmann's system theory as a method to analyze and study the unique functions of the legal system, eliminate the obstacles of dual coupling to communication, maintain social order, respond to changes in the economic system through legislation and judicial practice, and ensure the legitimacy and normativity of the market economy within the legal framework. In the institutionalized interaction between the legal system and the economic system, the criminal law subsystem plays its humble role and forms a strong coupling structure with other legal subsystems led by the administrative law system. It adjusts and regulates economic management activities in various aspects, stabilizes the economic and social order, and ensures more efficient operation of economic behavior.

영문 초록

经济系统通过对稀缺性的消除与重新构建，保证了系统内部的持续运行。然而，在以货币为首的稀缺性表现形式的影响下，交易主体间的互相影响通过市场与组织形成并不断扩大，甚至超出了经济系统所能控制的范围，这就需要制度化地构建起有关稀缺性的沟通。本研究以卢曼的系统理论为方法，通过对法律系统独有功能进行分析与研究，消除双重偶联性对沟通的阻碍，从而维护社会秩序，通过立法和司法实践对经济系统的变化作出回应，确保市场经济在法律框架内的合法性和规范性。法律系统与经济系统在制度化的互动中，刑法子系统发挥其谦抑性的特点，与以行政法子系统为首的其他法律子系统形成强有力的耦合结构，对经济管理活动进行多方面调整与规制，稳定了经济社会的秩序，保证经济行为更加高效运行。
