대테러체계 개선방안에 관한 연구 : 테러관련법제의 개정방향을 중심으로

국문 초록

최근 테러방지법의 개정 방향에 대하여 다양한 논의들이 이루어지고 있다. 이러한 상황에서 본 연구는 테러와 테러단체 등에 관한 개념의 재정립과 대테러 관계기관 간 임무·기능의 이관 필요성 여부 등에 초점을 맞추어 관련 법령 개정 사항을 검토하였다. 검토 결과 다음의 사항을 도출하였다. 첫째, 테러 개념을 재정립할 필요가 있으며, ‘국가의 권한행사 방해’라는 표현을 좀 더 구체화하기 위해 “국가기관”의 권한 행사로 변경하거나(중국 입법례), 정부에 영향을 미칠 목적(미국 입법례) 또는 정치, 종교, 인종이나 사상적인 명분을 고취시키기 위한 목적을 추가(영국 입법례)하는 방법을 고려해 볼 필요가 있다. 둘째, 테러단체의 개념을 현행 UN규제 테러단체 외에 국내에서 독자적으로 지정할 수 있도록 개정하되, 외국단체에 한해서 테러단체로 지정하거나(미국 입법례), 테러행위를 자행하거나 참가한 경우, 테러를 준비한 경우 또는 테러를 조장하거나 선동한 경우, 기타 다른 방법으로 테러와 관련된 경우에 테러단체로 인정한 것으로 한정하는 방법(영국 입법례)을 고려해 볼 필요가 있다. 셋째, 테러양상 변화에 따라 국가테러대책위원회 등 대테러기구에 과학기술분야 관계자들을 포함시키는 것이 바람직하며, 최근 국내 마약사범 급증과 테러자금 지원 양상이 지속되고 있다는 점을 고려하여 대테러관계기관에서 나코테러리즘에 관심을 기울여야 한다. 넷째, 테러대상과 테러수단에 대한 안전관리대책을 수립하기로 되어 있는 대테러관계기관은 그 당연한 전제로 현장 안전점검을 할 수 있도록 테러방지법 시행령에 안전점검 근거 조항을 마련할 필요가 있다.

영문 초록

Recently, various discussions have been made on the direction of the revision of the Anti-Terrorism Act. In this situation, this study reviewed the amendments to related laws, focusing on the re-establishment of the concept of terrorism and organizations and the necessity of transferring duties and functions between counter-terrorism-related organizations. As a result of the review, the following items were derived. First, it is necessary to redefine the concept of terrorism, and to further embody the expression “obstruction of the exercise of state authority,” it is necessary to consider changing it to the exercise of authority by a “state agency” (Chinese legislation), the purpose of affecting the government (US legislation), or adding a purpose (UK legislation) to inspire political, religious, racial, or ideological causes. Second, it is necessary to consider how to revise the concept of a terrorist organization to designate it independently in Korea in addition to the current UN-regulated terrorist organization (US legislation), but to designate only foreign organizations as terrorist organizations (US legislation), engage in or participate in terrorist activities, prepare for terrorism, promote or incite terrorism, or otherwise recognize it as a terrorist organization (UK legislation). Third, it is desirable to include scientific and technological officials in counterterrorism organizations such as the National Terrorism Countermeasures Committee in accordance with changes in terrorist patterns, and counterterrorism-related organizations should pay attention to Nako terrorism in consideration of the recent surge in domestic drug crimes and the continued support of terrorist funds. Fourth, counter-terrorism agencies that are supposed to establish safety management measures for terrorist targets and terrorist means need to prepare provisions on the basis for safety inspections in the enforcement decree of the Anti-Terrorism Act so that they can conduct safety inspections on-site on the natural premise.
