국문 초록

국회는 최근 사회적 참사와 관련한 각종 법률을 제정하거나 개정하고 있다. 그동안 각종 대형참사를 겪으며 법률과 정책적 대안을 마련하는 등 행정조직을 중심으로 재난에 대한 대응 역량을 강화했다. 그럼에도 2023년 여름 발생한 ‘오송 지하차도 참사’를 비롯하여 각종 재난에 대한 취약점은 계속 나타나고 있다. 그동안 재난이 발생하면 원인을 찾아 감시 및 감지 장비를 추가 설치했다. 수해와 산사태 등을 방지하기 위해 각종 시설물을 개량했다. 그럼에도 우리는 지금 안전하다고 생각하지 않는다. 진정으로 무엇이 문제인지 고민할 시점이다. 그동안 부족했던 법률은 계속 보완하되, 이제는 재난현장에서 실질적으로 중요한 의사결정에 주목할 필요가 있다. 아무리 재난에 대한 대비 및 대응 역량을 강화해도 최종적인 판단은 사람이 해야 한다. 그러면 누군가에게 권한과 책임을 부여할 것인가를 결정해야 한다. 현재와 같은 행정조직의 역할 책임과 권한 체계로는 계속적으로 혼란이 발생될 가능성이 높다. 화재나 인명구조는 소방이 범죄는 경찰이 담당하는 등 행정조직의 역할과 기능에 따라 책임과 권한이 명확한 영역도 있지만, 각종 복잡한 재난상황에서는 누가 지휘 권한을 가지고 책임 부담할 것인지 불분명하다. 피해 인원에 따른 재난현장 의사결정 체계를 구축하여 운영할 필요가 있다. 지방자치단체, 경찰, 소방 등 행정기관이 평상시에는 각자 역할을 하면서 일정 규모 이상의 재난이 발생하면 서로 소통하는 수준을 넘어서야 한다. 어떤 형태와 규모의 재난에서 누가 주도권을 가질 것인지에 대한 지휘체계를 마련할 필요가 있다. 본 논문에서는 지금까지 재난현장 의사결정과 관련하여 진행된 연구를 살펴보고, 의사결정 체계의 현실과 문제점을 진단한다. 그리고 재난현장 의사결정 체계 개선방안과 개발 필요성을 살펴본다.

영문 초록

The National Assembly has recently been enacting or revising various laws related to social disasters. In the meantime, we have experienced various large-scale disasters and strengthened our ability to respond to disasters, focusing on administrative organizations by preparing legal and policy alternatives. Nevertheless, vulnerabilities to various disasters continue to appear, including the ‘Osong Underpass Disaster’ that occurred in the summer of 2023. In the meantime, when a disaster occurred, the cause was found and additional monitoring and detection equipment was installed. Various facilities were improved to prevent flood damage and landslides. Nevertheless, we do not feel safe now. It is time to really think about what the problem is. While we continue to supplement laws that have been lacking so far, we now need to pay attention to practically important decisions at disaster sites. No matter how much we strengthen our ability to prepare for and respond to disasters, the final judgment must be made by humans. Then you need to decide whether to grant authority and responsibility to someone. There is a high possibility that confusion will continue to arise with the current role responsibility and authority system of administrative organizations. There are clear areas of responsibility and authority depending on the roles and functions of administrative organizations, such as firefighting in fire and lifesaving, and police in crime, but in various complex disaster situations, it is unclear who will have command authority and responsibility. There is a need to establish and operate a disaster scene decision-making system according to the number of victims. Administrative agencies such as local governments, police, and fire departments must go beyond the level of carrying out their respective roles in normal times and communicating with each other when a disaster of a certain scale occurs. There is a need to establish a command system for who will take the lead in disasters of any type and scale. In this paper, we review the research that has been conducted so far on disaster scene decision-making and diagnose the reality and problems of the decision-making system. We also look at ways to improve the disaster scene decision-making system and the need for development.
