국문 초록

유럽연합조약상 감사기관인 EU감사원에 의한 EU 내에서 재정통제는 먼저 민주주의 원리 측면에서 보면, EU시민 대표기관이라고 볼 수 있는 유럽의회와 회원국 대표기관이라고 할 수 있는 이사회의 재정통제를 지원하는 역할과 기능을 담당한다. 여기서 유럽의회와 회원국 의회의 헌법적 내지 유럽연합 조약적 의미가 완전히 동일하다고 보기는 어렵지만, 민주주의 원리 측면에서 행정부 즉, 위원회 중심의 예산집행에 대한 국민대표기관의 재정통제를 지원하는 감사원의 기능은 유사하다. 둘째, EU감사원의 감사범위는 EU 예산수입과 지출이 이루어진 모든 기관에 대해서 인정되지만, 감사업무의 효율성과 감사업무 수행의 독립성 측면에서 EU감사원이 재량으로 감사범위를 정하고 수행한다는 점에서 독자적인 권한행사를 할 수 있다. 셋째, EU감사원과 회원국 감사기관과 관계에서, 회원국 감사기관과 EU감사원은 상호 감사기관의 독립성을 인정하면서도, EU예산집행에 대한 감사업무에서는 협력관계를 이룬다는 특징을 확인할 수 있다. 넷째, EU감사원의 감사는 EU 예산집행에 대한 적법성과 효율성을 평가한다는 측면에서 법치국가원리가 실현되고 있음을 확인할 수 있다. 다만, 이 때 EU감사원의 감사결과는 법적인 구속력을 가지는 것이 아니라, 사실상 EU기관이나 회원국 기관에 대해서 실질적 영향력을 미친다는 점에서 그 효과는 법적인 강제가 아닌, 정치적인 또는 자문적인 효력을 가지는 것으로 제한적이다. 이러한 감사원의 기능은 헌법원리 측면에서도 의회가 국민의 뜻을 제대로 실현할 수 있도록 지원한다는 측면에서 민주주의 원리를 실현하고, 예산집행이 법규범에 따라 합법적으로 집행되도록 법치국가원리를 실현하는데 기여한다. 따라서 EU감사원은 유럽연합 조약체제 내에서 헌법적 차원에서 민주주의와 법치국가원리를 실현하는데 기여할 뿐만 아니라, 경제적 측면에서도 재정운용이 효율적으로 건전하게 실현되도록 실질적으로 공동체를 돕는 중요한 역할을 한다는 점에서 유럽연합 조약상―그리고 조약이 공동체의 헌법적 의미를 가진다면 헌법적―의미를 가진다.

영문 초록

If we look at the constitutional meaning of the European Court of Auditors(ECA) through the financial control carried out by the ECA within the European Union, it can be summarized as follows. First, from the perspective of democratic principles, the financial control of the EU budget carried out through the audit work of the ECA supports the financial control of the European Parliament, which can be seen as the representative body of EU citizens, and the European Council, which can be seen as the representative body of member states. It can be evaluated as being responsible for the following functions. In terms of democratic principles, the financial control function of the Board of Audit and Inspection can be said to be similar. Second, the audit scope of the ECA is recognized for all institutions that have made EU budget income and expenditures, but in terms of audit work efficiency and independence in audit work performance, the ECA exercises independent authority in that it determines and performs the audit scope at its discretion. Third, due to the limitations of the authority under the European Union Treaty, the member state audit institutions and the ECA establish a cooperative relationship in auditing the EU budget execution while recognizing the independence of each other's audit institutions. On the other hand, this is an aspect that passively confirms how important and necessary the financial control of a community is, whether a member state or the European Union. Fourth, the ECA's audit can confirm that the rule of law principles are being realized in terms of evaluating the legitimacy and efficiency of EU budget execution. However, in this case, the ECA's audit results are not legally binding, but in fact have a real influence on EU institutions or member state institutions, so their effect is limited to having a political or advisory effect, not a legal enforcement effect.
