국문 초록

헌법은 급변하는 사회현실에 대응하여, 헌법의 해석, 변천, 개정 등의 방식으로 대응할 수 있다. 현실적으로 헌법의 개정은 그것을 가능케 할 특수한 절차적, 상황적 조건이 갖추어졌을 때 비로소 가능해지므로, 일상적인 사회변화에 따른 규범적 수요가 발생하여 그것이 헌법적으로 해결되어야 하는 문제일 경우 헌법의 다양한 해석가능성을 모색해보고, 헌법조문의 종래 해석을 통해 문제가 해결될 수 없는 경우 헌법변천의 가능성을 살펴보아야 하며, 헌법변천의 한계를 넘게 되면 그 때 비로소 헌법개정을 통한 해결을 모색하는 수순으로 진행되어야 할 것이다. 이러한 전제 위에서 이 글에서는, 한국 사회가 당면한 사회변화의 구체적 사례로서, 국가영역에서 발생한 정치현실의 구조적 변화와 사회영역에서 발생한 가치관의 변화와 관련한 두 개의 사례를 들어, 사회변화와 헌법의 관계 및 한국헌법의 가능한 대응방법을 모색하였다. 전자의 사례로, 최근 문제되고 있는 대통령의 인사권 행사와 관련한 소위 ‘고유권한’ 논리가 한국헌법의 역사적, 규범적, 정치발전적 관점에서 문제가 있음을 지적하고, 유효한 통제에서 벗어난 대통령의 권력행사와 부적절한 인사관행의 문제가 과연 헌법의 문제인지, 정치제도에 대한 헌법개정이 반드시 수반되어야 하는지에 대한 근본적 성찰을 제기하였다. 후자의 사례로, 동성혼에 대한 사회가치관의 변화를 고려하여, 한국헌법하에서 동성혼을 법적으로 수용할 수 있을지, 역사적, 비교법적 관점에서 검토하고, 사회변화에 적절히 대응하기 위한 한국헌법의 해석과 변천 가능성을 모색하였다. 결론적으로, 사회현실의 변화와 가치관의 변화에 대한 법적 대응이 요구될 때, 국회의 입법과 헌법의 해석ㆍ변천ㆍ개정을 통한 방법을 적절히 활용하여, 사회변화에 보조를 맞추면서도 법질서를 안정적으로 운용하는 지혜를 발휘해야 할 것이다.

영문 초록

Constitutions can respond to rapidly changing social realities by interpreting, changing or amending them. In practice, amendments to the constitution are only possible when special procedural and situational conditions are in place to make them possible, so when legal demands arise from everyday social changes that require a constitutional solution, various interpretations of the constitution should be explored; when the problem cannot be solved through interpretation of constitutional provisions, the possibility of transformative change in the constitutional meaning of given provisions should be explored; and when the limits such change are exceeded, only then should a solution be sought through constitutional amendment. In this sense, this article explores the relationship between social change and the Constitution and the possible responses of the Korean Constitution, using two specific examples of social change facing Korean society: changes in political reality in the state sphere and changes in public sense of values in the society. In the former case, it points out that claims of the so-called ‘president's inherent power’ related to the exercise of personnel power is problematic from the historical, normative, and political perspectives of the Korean Constitution, and raises critical questions about whether the problem of presidential power that has deviated from effective control and improper personnel practices is indeed a constitutional problem, and whether constitutional amendments to the political system must be accompanied. In the latter case, in view of the changes in the public sense of value in society on same-sex marriage, it examines whether same-sex marriage is legally acceptable under the Korean Constitution from a historical and comparative perspective, and explores the possibility of interpreting and transformatively changing the existing interpretation of the Korean Constitution to respond appropriately to social changes. In conclusion, when legal responses to changes in social reality and changes in the public sense of values in society are required, it is crucial to make appropriate use of parliamentary legislation and constitutional interpretation, informal change, and amendment to keep pace with rapid social change while maintaining a stable legal order.
