보호출산제로 태어난 아동의 국내 입양절차 변화

국문 초록

본 연구는 보호출산제로 태어난 아동의 국내 입양절차는 어떻게 변화할지살펴보고 이로 인해 발생할 수 있는 문제점들을 검토하기 위해 수행하였다. ‘국내 입양에 관한 특별법’과 ‘위기 임신 보호출산 지원과 아동보호에 관한 특별법’을 각각 검토하여 내용을 분석한 후, 입양절차를 도식화하여 드러나는 문제점을 살펴보았다. 분석결과, 1) 출산과 출생통보 시점에서 출산 전 입양 의사표현과 생부모의 범위 확대, 숙려기간, 출산 후 신청 시 절차단축, 보호자 대리신청 가능, 아동 성·본 창설, 출생기록 삭제 후 가족관계 재등록, 2) 입양상담과 입양대상아동 결정 시점에서는 아동복지법에 따른 아동보호전담요원 상담 생략과 생부모 정보기재, 3) 아동보호 시점에서는 친권정지일과 철회시점등에서 입양절차상 변화와 그에 따른 문제점을 발견할 수 있었다. 연구를 바탕으로 보호출산제도 개선에 관한 정책적·실천적 노력을 제안하였다

영문 초록

This study was conducted to examine how domestic adoption procedures for children born under the anonymous birth system might change and to review potential issues that may arise as a result. The study analyzed the “Special Act on Domestic Adoption” and the “Special Act on Support for Crisis Pregnancy, Protected Birth, and Child Protection”. After analyzing the contents of these laws, the adoption procedures were visualized to identify emerging issues. The analysis revealed changes and associated issues in the adoption process, including expressions of intent for adoption before birth, expansion of the scope of biological parents, consideration periods, shortened procedures when applying post-birth, proxy applications by guardians, creation of a child’s surname and clan seat, re-registration of family register after deleting birth records, omission of consultations with child protection officers under the Child Welfare Act, recording of biological parent information, and the timing of parental rights suspension and withdrawal. Based on this study, policy and practical recommendations are proposed to improve the anonymous birth system.
