살인범죄자 양형 영향요인 연구 - 남녀 집단 차이 중심으로

국문 초록

이 연구의 목적은 국내 살인범죄자를 남녀 집단으로 나눠 형량 영향요인에 성차가 존재하는지 경험적으로 분석하는 것이다. 양형요인은 판결문에 제시된 것들로 구성하였다. 범죄동기유형과 특별가중 및 감경요인 등 양형기준 내 요인과 범죄전과, 경합 범, 흉기사용 등 양형기준 외 요인이 그것이다. 연구대상은 2012년부터 2023년까지 서울지역 법원에서 1명의 가해자가 살인혐 의로 1심에서 유죄가 선고된 사건 232개이다. 연구결과, 남녀 집단별로 형량에 유의미하게 영향을 미치는 요인이 차이가 있었 다. 계획범행과 잔혹수법, 전과, 경합범은 남성의 형량만 더 증가시켰다. 자수와 심신미약은 여성의 형량만 더 감소시켰다. 다만, 남녀 모두 범죄동기유형이 심각할수록 형량이 더 늘었고, 피해자 유발이 인정되면 형량이 더 줄었다. 연구결과를 토대로 연구의 한계점과 함께 살인범죄 양형 성차를 최소화하기 위한 정책적 제안을 제시하였다.

영문 초록

The purpose of this study is to empirically analyse whether there are gender differences in sentencing factors by dividing homicide offenders into male and female groups. The independent variables in this study are the sentencing guideline factors (eg., type of motive, premeditation, brutality) and non-sentencing guideline factors (eg., use of a weapon, concurrent offences, previous convictions). The dependent variable in this study is the length of the sentence. The dataset consists of 232 cases of homicide convictions handed down by the Seoul District Courts between 2012 and 2023. The results show that the impact of sentencing factors varies significantly by gender of homicide offenders. It reveals that premeditation, brutality, previous convictions and concurrent offences have a significantly positive impact on the sentencing of male offenders. It is found that voluntary reporting and mental and physical incapacity have a significantly negative impact on the sentencing of female offenders. For both male and female offenders, sentencing is harsher when the type of motive is more serious, whereas the victim's provocation is found to have a significantly negative impact on the sentencing. Based on the findings, this study addresses the limitations and proposes policy recommendations to reduce the gender gap in the sentencing of homicide offenders.
