국문 초록
The rapid development of Internet technology has revolutionized judicial trials, and as an emerging trial mode, asynchronous trial shows great potential in improving judicial efficiency and breaking geographical restrictions. The embodiment and value of Marxist legal theory in Internet asynchronous trial reveals its theoretical support in the synchronization of legal development and social development, the pursuit of the value of the law serving the people, and the potential of the combination of technology and law. Based on the practice of Internet asynchronous trial in different regions, to explore its concrete implementation at the level of legislation and application of science and technology. Internet asynchronous trial has achieved remarkable results in safeguarding procedural justice and enhancing trial efficiency, but there are problems such as the formation of judges' mind evidence and hollowing out of debates. Marxist legal theory provides theoretical guidance for Internet asynchronous trial, emphasizing that the law should be synchronized with social development and make full use of the advantages of modern information technology. Under the guidance of Marxist legal theory, the Internet asynchronous trial mode can better reflect the fairness and convenience of justice and meet the people's expectations for judicial justice and efficiency.
영문 초록
互联网技术的迅速发展给司法审判带来的革命性变化，异步审理作为一种新兴的审判方式，提高了司法效率并打破了地理限制。马克思主义法律理论在互联网异步审理的实例中体现出法律与社会发展的同步性、法律服务于人民的追求，以及技术与法律结合的潜力。问题聚焦在异步审理的立法和科技应用的实践探索可能存在的如法官心证形成和辩论空洞化的问题。通过对不同地区互联网异步审理的实践进行分析，并探讨异步审理在立法层面和科技应用层面的具体实施情况。互联网异步审理在提升审判效率方面取得了显著成效。马克思主义法律理论为互联网异步审理提供了理论指导，强调法律应随着社会发展而发展，服务于人民，并充分利用现代信息技术的优势，使互联网异步审理可以更好地体现司法的公正性和便利性。
