제4차 국가인권정책기본계획 수립을 위한 검토

국문 초록

2018년부터 2022년까지를 시행기간으로 하는 제3차 국가인권정책기본계획이 종료된 지 1년이 넘었지만, 아직까지 제4차 국가인권정책기본계획이 수립되지 못하고 있다. 원래대로라면 제4차 국가인권정책기본계획은 2023년부터 2027년까지 5개년 계획으로 수립되었어야 하겠지만, 이미 2024년이 되었기에 2024년부터 2028년까지의 5개년 계획으로 수립되어야 할 상황이다. 2007년 처음 수립된 국가인권정책기본계획은 제2차 계획이 종료된 2016년에도 1년 동안 공백기가 있었다. 그러나 이 당시에는 박근혜 대통령에 대한 탄핵으로 대통령 선거가 치러지는 특수한 사정이 있었고, 다른 특별한 사정없이 정부가 추진하는 기본계획의 수립이 1년 이상 지연되는 것은 매우 이례적이다. 국가인권위원회는 이미 2022년 7월에 제4차 국가인권정책기본계획 권고안을 의결하고, 대통령에게 제4차 국가인권정책기본계획의 수립을 권고했다. 물론 정부 내에서 국가인권정책기본계획의 수립을 총괄하고 있는 법무부도 마냥 손을 놓고 있는 것은 아니었다. 2022년 4월부터 8월까지 외부 연구용역을 통해 제3차 국가인권정책기본계획에 대한 이행평가를 실시했고, 2023년 8월에는 제4차 국가인권정책기본계획 추진과제 초안을 제시하면서 이를 기반으로 관련 분야 전문가들의 의견을 듣는 공청회를 개최했다. 그런데 이 공청회 이후로 7개월 가까이 수립 절차가 계속 지연되고 있는 것이다. 정부의 향후 5년 동안의 인권정책의 청사진을 제시하는 제4차 국가인권정책기본계획이 더 이상 지체되지 않고 수립되기를 바라며, 이 논문에서는 제4차 국가인권정책기본계획 중 시민적·정치적 권리 분야의 추진과제들을 중심으로 그 구성 체계와 개별 추진과제들에 관하여 검토해보기로 한다.

영문 초록

It has been more than a year since the end of the 3rd National Action Plan for the Promotion and Protection of Human Rights (NAP), which had its five-year implementation period from 2018 to 2022, but the 4th NAP has not yet been established. Originally, the 4th NAP should have been established as a five-year plan from 2023 to 2027, but since it is already 2024, it should be established as a five-year plan from 2024 to 2028. The NAP, which was initially established in 2007, had a one-year gap in 2016 when the 2nd NAP was ended, but at that time, there were special circumstances in which the presidential election was held due to the impeachment of the president of Park Geun Hye. And it is very unusual that the establishment of the government’s basic policy plan has been delayed for more than a year without such special circumstances. In July 2022, the National Human Rights Commission of Korea (NHRCK) has already adopted the recommended draft for the 4th NAP and recommended the President to establish the 4th NAP. Of course, the Ministry of Justice, which is in charge of establishing the NAP within the government, was not just sitting idle. The evaluation of implementation the 3rd NAP had been conducted through external research services from April to August 2022, and a public hearing was held in August 2023 to listen to the opinions of experts in related human rights fields while presenting the draft of the 4th NAP. However, since this public hearing, the establishment process of the 4th NAP has been continuously delayed for nearly seven months. I hope that the 4th NAP, which is a government’s blueprint for human rights policy of the Republic of Korea over the next five years, will be established without further delay, and I will examine the composition and individual tasks of the 4th NAP, focusing on the tasks for the civil and political rights.
