항공 교통약자의 권리보호에 관한 고찰

국문 초록

본 논문은 코로나19를 거치면서 항공운송 수요가 회복기에 접어든 현재 시점에서 장애인을 비롯한 교통약자의 인권을 고려하여 원활한 항공여행을 위한 제도적인 사항들을 점검해 볼 의도에서 저술되었다. 본 논문은 크게 세 단락으로 구성되어 있다. 첫 번째 단락에서는 항공교통의 공공성과 교통약자의 기본적인 인권에 해당하는 이동권에 대한 이론적 고찰을 다루었다. 특히 국가에 의해 운영되지 않는 민간 상업 항공사가 공공성을 가지는지를 탐구하였으며, 나아가 항공운송에서 교통약자의 이동권이 보장되어야 하는 이유도 중점적으로 다루었다. 두 번째 단락에서는 항공 교통약자의 이동권을 보장하기 위한 비교법적인 내용을 검토하였다. ICAO와 IATA의 규정을 국제적인 기준으로 살펴보고, 미국과 EU 등 항공 선진국의 입법사례를 분석하였다. 국제적인 기준과 선진국의 사례를 비교하여 항공 교통약자의 이동권을 보장하기 위한 구체적인 방안을 탐색하였다. 세 번째 단락은 현행 우리나라의 항공사업법 및 동 시행규칙에서 항공 교통약자에 관한 규정을 살펴보고 이에 대한 내용적인 부분을 검토하여 향후 개정 방향을 제안하고자 하였다. 항공운송은 사회 전반에 걸친 교통수단으로서 중요한 역할을 담당하고 있다. 그러나 교통약자, 특히 장애인은 항공운송 서비스의 이용에 있어서 여러 어려움에 직면하고 있다. 법률 개정만으로는 이러한 문제를 해결하기 어렵기 때문에, 항공운송의 공공성을 인식하고 이를 토대로 교통약자의 권익을 보장하는 노력이 필요하다. 이 논문은 이론적인 측면에서 항공운송이 공공적인 성격을 지닌 이유와 교통약자의 배제를 방지해야 하는 이유를 탐구하였다. 또한 실제적인 측면에서는 선진 국가들이 항공운송 분야에서 교통약자 보호를 위해 어떠한 법적 조치를 취하고 있는지를 조사하여, 이를 바탕으로 한국에서 교통약자의 권익이 보다 효과적으로 보장될 수 있는 방안을 제시하려 노력하였다. 이 논문을 통해 항공운송 분야에서의 교통약자 보호에 대한 이론과 실제적인 해결책에 대한 인식을 높이고, 국내 정책 및 제도의 개선에 기여할 수 있기를 기대한다.

영문 초록

The purpose of this paper is to examine the institutional arrangements in place to facilitate air travel for people with disabilities and other transportation disadvantaged populations as air transportation demand begins to recover from the COVID-19 pandemic. The paper is organized into three main sections. The first section is a theoretical review of the public nature of air transportation and the mobility rights of people with disabilities. In particular, it discusses how private commercial airlines, which are not operated by the state, are public, and furthermore, why the right to mobility of persons with disabilities should be guaranteed in air transportation. In the second paragraph, we reviewed the comparative legal framework for ensuring the right to mobility of persons with disabilities in air transportation. The regulations of ICAO and IATA were examined as international standards, and legislative examples of developed aviation countries such as the United States and the European Union were analyzed. Through this, we explored various ways to ensure the right to mobility of the air traffic disadvantaged by comparing international standards and cases from advanced countries. The third paragraph examines the provisions related to the air traffic disadvantaged in Korea's Aviation Business Act and its implementing regulations, and suggests future revisions. Air transportation plays an important role as a means of transportation for the entire society. However, the transportation disadvantaged, especially people with disabilities, face many difficulties in using air transportation services. Since it is difficult to solve these problems through legal amendments alone, it is necessary to recognize the public nature of air transportation and make efforts to ensure the rights and interests of the transportation disadvantaged based on this. From a theoretical perspective, this paper explored the reasons why air transportation is public and why it is necessary to prevent the exclusion of the disadvantaged. From a practical perspective, it investigated what legal measures developed countries are taking to protect the disadvantaged in the field of air transportation and tried to suggest ways for Korea to realize the rights and interests of the disadvantaged more effectively. This paper is expected to raise awareness of the theoretical and practical solutions for the protection of the disadvantaged in air transportation and contribute to the improvement of domestic policies and systems.
