국문 초록

2021년, 대한민국의 의료법은 병원 수술실(OR)의 폐쇄회로 텔레비전(CCTV) 카메라 설치및 운영에 관한 제38조2항이 포함되도록 개정되었다. 2023년 9월부터 시행된 이 개정안은 국내병원의 수술실에 CCTV를 의무적으로 설치하도록 하고, 의식이 없는 상태에서 수술받는 환자에게 이 카메라를 통해 수술 영상을 녹화할 수 있는 옵션을 제공한다. 제38조2항은 논란의 여지가있었고 여전히 남아있다. 대중의 압도적인 지지를 받고 있음에도 불구하고 국내 의사, 병원, 의료단체 등의 거센 반대에 직면하고 있다. 이 논문은 이 새로운 법이 윤리적으로 정당한지, 어느 정도까지 정당한지를 결정하기 위한 노력의 하나로 이 법에 대한 찬반 주장을 제시하고 평가하려고한다. 제공된 분석에서는 결과주의적 관점과 권리 기반 관점, 두 가지 관점에서 제38조2항을 검토한다. 새 법이 국내 대리수술 발생률을 줄인다는 일차적 목표를 달성할 수 있을지는 아직 판단하기 이르지만, 현재 확실하게 예측할 수 있는 법 시행의 결과는 순기능이 될 가능성이 높다는 주장이다. 더욱이 제38조 2항은 전신마취 수술을 받는 환자의 중요하지만, 과소평가되는 권리, 즉수술 후 의식이 없는 동안 누가 자신에게 무엇을 했는지 알 수 있는 권리를 보호하는 데 도움이 될것이라고 주장한다.

영문 초록

In 2021, South Korea’s Medical Service Act was amended to include Article 38-2, which concerns the installation and operation of closed-circuit television (CCTV) cameras in hospital operating rooms (ORs). This amendment, which went into effect in September 2023, requires hospitals in South Korea to maintain CCTV in their ORs, and it provides patients who undergo surgery while they are unconscious the option of having their surgeries video recorded by means of these cameras. Article 38-2 has been, and remains, controversial; although it enjoys overwhelming public support, it has encountered strong opposition from doctors, hospitals, and medical organizations in the country. This article lays out and evaluates the arguments that have been advanced both for and against this new law in an effort to determine whether, or to what extent, it is ethically justified. The analysis that is provided examines Article 38-2 from both consequentialist and rights-based perspectives. It is argued that while it is too early to determine whether the new law will succeed in its primary objective of reducing the incidence of ghost surgery in South Korea, the consequences of the law that can be predicted with any certainty at the present time are likely to be net beneficial. Furthermore, it is argued that Article 38-2 will help to protect an important yet underappreciated right of patients who undergo surgery involving general anesthesia, namely, their postsurgical right to know who did what to them while they were unconscious.
