의료의사결정에서 철학교육의 활용

국문 초록

기억의 기능과 내용을 인위적으로 수정하고 삭제할 수 있는 기억수정기술(Memory Modification Technologies/MMT)의 가능성이 예견되면서, 인간 정체성 문제, 행위자성 문제, 공동체적 문제 등 기억수정이 일으킬 수 있는 다양한 측면의 문제들이 제기되고 있다. 본 연구는 이 문제에 대해 하나의 윤리적 입장을 취하는 대신 예상되는 부정적 결과를 최소화하기 위한 실천적인 대비책을 모색하고자 하였다. 이를 위해 기억수정치료에 있어서는 환자의 동의가 치료 결정에가장 중요한 판단이 될 것이라는 전제하에 기억수정치료에 가장 적합한 자율성 존중 개념은 어떤 요소를 포함하고 있어야 하는지를 검토하였다. 의료진의 정확한 정보전달이 중심이었던 비첨과 칠드리스의 자율성에 대한 논의보다 환자의 숙고과정을 중시하는 밀러의 자율성 개념에 관계적 자율성의 개념을 결합한 최경석의 개념이 기억수정 동의에 있어서 더 적합할 것으로 보인다. 또한 이를 위해 ‘숙고할 의무 및 숙고 과정에서 공동체적 도움을 받을 권리’를 함께 제안하고자 한다. 본 논의에서 제안하는 동의과정은 기억수정과 관련된 문제에 대한 철학적 숙고를 필요로 하며, 이 과정에 철학지식이 아닌 철학적 사유 자체를 키우고자 하는 철학교육의 방법이 수행되어야 한다. 이에 본 연구는 기억수정 논의에서 그동안 부족했던 실천적인 논의에 대한 한 가지 방안으로, 립맨의 철학적 탐구공동체 방법론을 활용하여 제시해 보고자 하였다. 이 방법론은 환자가기억수정 후의 결과들을 지나치게 단편적이고 피상적으로 생각하지 않도록 이끌며, 보다 신중하게 동의여부를 결정할 수 있게끔 돕는 효과적인 실천적 활용방안이 될 것이다.

영문 초록

As the possibility of Memory Modification Technologies (MMT), which can artificially modify and delete the functions and contents of memory, is being discussed. And various ethical issues related to memory modification, such as questions of human identity, agency, and communal implications are being raised. This study aims to explore practical methodology to minimize anticipated negative consequences instead of taking a single ethical standpoint on these issues. Based on the premise that patient consent is the most important determinant of MMT treatment decisions, we examined what elements of the concept of respect for autonomy are most appropriate for MMT. In contrast to discussions of autonomy by Beauchamp and Childress, which focus on the accurate disclosure of information by medical professionals, this study suggests that Kyungsuk Choi’s concept of autonomy, which combines Miller’s emphasis on the patient’s deliberation process and incorporates the concept of relational autonomy, is more suitable for consent to MMT. Furthermore, we propose adding elements of the right to ‘mandatory deliberation and receiving communal assistance in the process of deliberation.’ This consent process requires philosophical thinking on issues related to MMT, and we believed that philosophy education, which aims to nurture philosoph-ical thinking rather than to teach knowledge, would be helpful. Therefore, this study aims to present an approach to the practical discussion that has been lacking in discussions about MMT, using Lipman’s methodology of philosophy education. Lipman’s methodology of ‘philosophical community of inquiry’ is expected to guide the patient to think more comprehensively and deeply about ethical issues related to memory modification, thereby facilitating a more careful determination in consent process.
